Regarding the substance of the questions asked, I can state the following:

Question: During what period of time were you in Khattab's camps and when did you meet Abu Umar? Give a description of Abu Umar's appearance.

Answer: I was in Khattab's camp near the settlement of Serzhen-Yurt in Chechnya for the first time in early 1997, when I was undergoing the so-called 'training course' [uchebka], and for the second time at the end of the same year. This time I worked in this camp as a driver of a 'Ural' truck. I met Abu Umar during my first visit to this camp. Abu Umar is about 170 - 175 cm tall, thin, looks about 30 years old. He had long black hair and a beard. Black eyes. Skin color typical for an Arab - dark. His appearance was typically Arabic. I don't remember any special features. Previously, he constantly wore a gray coat, knee-length. He preferred to wear national Arabic clothing: something like a dress and wide trousers. At that time (in 1997), he almost constantly carried an automatic rifle; there was no pistol.

Question: What was the name of the unit headed by Abu Umar, what did it do, and where was it based?

Answer: In 1997, in the 'training course' near Serzhen-Yurt, there was an Arab named Abu Bakr. He was missing one leg and walked with a prosthesis. He knew explosives very well and taught this only to Arabs. Abu Umar also studied under him. After Abu Bakr died during the attack on Buinaksk (I don't know the circumstances), Abu Umar created the 'Mutafadjirat' detachment (as far as I know, translated from Arabic - 'Explosives Experts' [Vzryvniki]). The detachment was based near the 'training course', a bit to the side, closer to the river. I don't know who was in the detachment or who was recruited there. At first, I didn't know what they were being taught there, but later I found out that they were being taught explosives. I don't know who the instructor was there, maybe Abu Umar himself, but to be honest, I don't think he was a good explosives specialist.

Question: What is the size of this detachment, its armament, location, national composition, structure, and tactics?

Answer: I don't know such details. Regarding nationality, I can say that there were people of all nationalities.

Question: What do you know about the actions carried out by members of 'Mutafadjarat' on the territory of Russia in the period from 1997 to the present?

Answer: I think that the people who were trained by Abu Umar were with Achimez Gochiyayev in Moscow in 1999. Batchayev Timur, with whom we...

Questions and Answers

Question: What do you know about the explosions on March 19, 1999, at the Central Market of Vladikavkaz and on May 16, 1999, of three residential buildings in the military town "Sputnik" on the territory of the Republic of North Ossetia - Alania?
Answer: I know nothing about this.

Question: What do you know about the circumstances of the death of Tsokiev Magomed Dautovich, known to you by the name Moaz?
Answer: I do not know about this.

Question: Explain why an Arab named Abu Umar approached you specifically with a proposal for the preparation and implementation of acts of terrorism?
Answer: I do not know why Abu Umar approached me specifically. I did not refuse this proposal because any work for the Arabs was well paid, and I had to support my family.

Question: In the interrogation of July 15, 2002, you testified that Abu Umar gave you money for the preparation and commission of acts of terrorism in the amount of 3 - 3.5 thousand US dollars, and in the interrogation of July 19, 2002, you indicated another amount - 3.5 - 4 thousand. Clarify what amount of money Abu Umar gave you.
Answer: I do not remember exactly the amount of money given to me by Abu Umar, it was a very long time ago - three years ago. I only remember that it was about three and a half thousand dollars.

Question: Explain what amount of mixed explosive material was produced by the criminal group with your participation and how much explosive material was brought by you to the city of Volgodonsk for the commission of an act of terrorism?
Answer: I cannot say exactly how much explosive was produced. Achimez Gochiyayev took about 200 bags of explosives to Moscow, approximately 10 tons, we took about 80-100 bags to Volgodonsk, approximately 4-5 tons.

Question: At the Erken-Shakhar sugar factory, you purchased 280 sugar bags. Indicate whether all the bags were filled with the explosive material manufactured in the village of Mirny? If not, where were the remaining bags used?
Answer: As far as I remember, all the bags I bought were filled with explosives.

On the merits of the questions asked

Question

You are being presented for inspection with a clock mechanism and two electric detonators of the ED-3-ZN and ED-8Zh brands, seized during the inspection of the premises at the address: Moscow, Borisovskie Prudy St., house 16, bldg. 2. Are these items familiar to you? If yes, where and when did you see them?

Answer

I have carefully examined the items presented to me and want to state that these items are familiar to me, but I saw them for the first time during the war in the territory of Chechnya in Abu Jafar's detachment. Before the explosions in 1999 in the cities of Moscow and Volgodonsk, I did not see them. I theoretically know how such a clock mechanism is made, but I have never made one myself. I heard about this from someone in the detachment; I know that in the electronic clocks used in such a clock mechanism, the alarm contact needs to be resoldered to connect some parts in series into an electrical circuit, but I cannot do this myself and have not seen how it is done. I saw electric detonators in Abu Jafar's detachment quite often; mining was carried out with their help. I repeat that I did not see such a clock mechanism and electric detonators with anyone in the summer of 1999, I mean Achimez Gochiyayev, the Batchayev brothers, and others who manufactured explosives in the village of Mirny.

Question

You are being presented for inspection with three color photographs of the leaders of illegal armed groups (NVF) on the territory of the Chechen Republic (appendix to expert opinion No. 3/400 dated November 5, 2001, designated as photos 5, 6, and 7). Are these faces familiar to you? If yes, who specifically is familiar to you and when did you see him?

Answer

I have carefully examined the three photographs presented to me and can state that in photograph number 5 I recognize: the second from the left is Khattab, the far right is a Chechen named Elsi. I do not know the other two men. In photograph No. 6, I also identify the man sitting on the left as an Arab named Khattab, the far right is the Chechen Elsi. I do not identify the man sitting between them. I do not identify the man in photo No. 7. During my entire stay in Chechnya, I saw Khattab two or three times. The last time I saw him was in the summer of 2000, when he came to our detachment, which was then located in the forest near Serzhen-Yurt. Before that, I saw him in the winter at the beginning of 2000, when I called my wife's sister from a satellite phone belonging to Khattab. I saw the Chechen named Elsi for the first time in 1997 in a camp near Serzhen-Yurt. Elsi, as far as I know, fought in the first

Testimony

Near the military camp there was a small brick building in the form of a canteen. On its edge stood a mill; I didn't go in there myself. I don't know what they did at this mill or who worked there. I wasn't interested in that.

Question: Are you aware that an improvised explosive based on ammonium nitrate and aluminum powder was produced at this mill?

Answer: No, I know nothing about that. As I said, I didn't pay attention to this mill.

Question: What do you know about what cargo a person known to you as Saleh brought in the summer of 1999 to the house of Zukhra Karabasheva in the village of Mirny, where the explosive was produced?

Answer: As far as I remember, Saleh came in a "KAMAZ" together with Hakim Abaev twice. He brought sugar bags with some substance. I was told it was ammonium nitrate. A plastic bag was inserted into this bag so that the mixture would not spill. The bag itself was tied, not sewn. The nitrate was finely ground; its color was light. I didn't see the arrival of Saleh and Hakim myself; I only saw the bags stacked by the shed. In some bags, the mixture was compressed into a lump, as it was visible that the bags had solid contents. Then this mixture was mixed with aluminum powder, after which it became crumbly. This mixture strongly attracted moisture, so we were in a hurry to pack it into bags.

Earlier in interrogations, I said that Hakim Abaev brought the nitrate, without mentioning Saleh, because I was sure that it was Hakim who got it, and Saleh was used only as a driver.

Accused (signature)

At the end of the interrogation, Adam Dekkushev was provided with a sheet of A4 paper and a blue ballpoint pen, after which Dekkushev

Statement of Guilt

  • I confirm that Batchayev and Yusuf Krymshamkhalov agreed with me; Batchayev and I decided to go to Volgodonsk and see on the spot what could be done there. I have already given detailed testimony about this, and I fully confirm it.

Admissions of Guilt

  • I plead guilty to the fact that as a result of the explosion of a residential building in Volgodonsk, a large number of people were killed and injured, which constitutes the commission of crimes provided for by:
    • Paragraphs 'a', 'v', 'd', 'e', 'zh' and 'n' of part 2 of article 105, part 3 of article 30, and paragraphs 'a', 'v', 'd', 'e', 'zh' and 'n' of part 2 of article 105 of the Criminal Code of the Russian Federation.

  • I partially plead guilty to the manufacture of explosives.
    • In the summer of 1999, I purchased bags, sugar, potatoes, brought aluminum powder, a sewing machine, etc., but I did not manufacture the explosive myself, nor did I participate in its mixing.
    • I did not purchase detonators, etc.
    • I plead guilty to repeated storage and transportation of explosives, in particular from the village of Mirny to Kislovodsk, and then to Volgodonsk.
  • I did not manufacture the explosive device in Volgodonsk; Timur Batchayev was involved in this.
  • I want to state that I was not involved in the bombings of houses in Moscow in September 1999. This was done by Achimez Gochiyayev's group; I knew nothing about the fact that these houses would be blown up. Accordingly, there will be no recurrence of acts of terrorism and murders of people in my actions.

I declare that I fully confirm the testimony previously given by me during the preliminary investigation.

On November 19, 1999, rulings were issued in the case to charge A.O. Dekkushev as an accused under Part 3 of Art. 205 and Part 3 of Art. 222 of the Criminal Code of the Russian Federation, to select a preventive measure in the form of detention, and to declare him wanted.

On July 14, 2002, A.O. Dekkushev was detained by law enforcement agencies of the Republic of Georgia on the territory of that state and, in accordance with the 1993 Minsk Convention of the CIS countries, was handed over to the Russian Federation. On the same day, A.O. Dekkushev was charged, and detention was chosen as the preventive measure against him.

In addition, sufficient evidence has been collected in the criminal case regarding the direct participation of A.O. Dekkushev in the implementation, as part of the above-mentioned organized criminal group, of the terrorist act of September 16, 1999, in the city of Volgodonsk - an explosion in the courtyard of house No. 35 on Oktyabrskoye Highway, as a result of which 19 people died and over 1000 people received bodily injuries of varying degrees of severity, and significant material damage was caused to the state and citizens.

* Conduct a number of other investigative actions to consolidate the evidence collected in the case, after which A.O. Dekkushev will need to be charged in full.
