Decision on Extension of Detention

A.O. is accused of committing an especially grave socially dangerous act, committed by a group of persons, which may obstruct the establishment of the truth in the criminal case and hide from the preliminary investigation authorities and the court. In addition,

Having examined and analyzed the submitted materials, having heard the opinions of the participants in the process, the court considers that the petition to extend the period of detention of Adam Dekkushev under custody is subject to satisfaction.

The court established that:
* The criminal case was initiated by the proper official.
* Adam Dekkushev was detained in accordance with the criminal procedural legislation in force at the time of this investigative action.
* The charge was brought against him within the established time limits, and the measure of restraint was chosen, authorized, and its effect extended by the authorized officials.
* The resolution to initiate the petition was drawn up in compliance with the requirements of the criminal procedural law and submitted to the court with the consent of the prosecutor within the established time limits.

When deciding on the issue of extending the period of detention of Adam Dekkushev under custody, the court takes into account that:
* He is accused of a socially dangerous act belonging to the category of especially grave, for the commission of which punishment in the form of deprivation of liberty for a term of more than 2 years is provided.
* The circumstances and nature of the imputed socially dangerous acts – committed by a group of persons, data on the personality of the accused allow to believe that while at large Adam Dekkushev may hide from the preliminary investigation authorities and the court, threaten witnesses and victims in the case and continue to engage in criminal activity, thereby obstructing the establishment of the truth and the proceedings in the case.
* The court also takes into account the family situation of the accused, the presence of minor children born in 1989 and 1991, and the state of health of Adam Dekkushev.
* The court takes into account the volume of investigative actions that must be performed by the criminal prosecution authorities.

Based on the foregoing and guided by Art. 109 of the Code of Criminal Procedure of the Russian Federation,

DECIDED:

To extend the period of detention under custody of the accused ADAM OSMANOVICH DEKKUSHEV, born February 03, 1962, a native of the Karachay-Cherkess Autonomous Oblast, Stavropol Krai, the city of Karachayevsk, for 3 (three) months, and for a total of up to 9 (nine) months 25 (twenty-five) days, that is, until May 09, 2003.

This ruling may be appealed to the Moscow City Court within 10 days from the date of its issuance.
