...производство 09 сентября 2002 года из уголовного дела №103, возбужденных 13 и 16 сентября 1999 года по фактам взрывов жилых домах в г. Москве и г. Волгодонске, Ростовской области.

19 ноября 1999 года в отношении Деккушева А.О. вынесено постановление о привлечении его в качестве обвиняемого по ч. 3 ст. 205, ч. 3 ст. 222 УК РФ.

19 ноября 1999 года заместителем начальника 3-го отдела СУ ФСБ РФ Розанова А.А. вынесено постановление об избрании в отношении Деккушева А.О. меры пресечения в виде заключения под стражу.

14 июля 2002 года Деккушев А.О. задержан правоохранительными органами Республики Грузия на территории данного государства, и передан Российской Федерации. В этот же день ему было предъявлено обвинение и избрана мера пресечения в виде - заключения под стражу.

13 сентября 2002 года Лефортовским районным судом г. Москвы срок содержания обвиняемого Деккушева А.О. под стражей продлен до 3-х месяцев 26 дней, то есть до 09 ноября 2002 года.

04 ноября 2002 года Басманным районным судом г. Москвы срок содержания обвиняемого Деккушева А.О. продлен до 6-ти месяцев 26 дней, то есть до 09 февраля 2003 года.

14 января 2003 года уголовные дела в отношении Деккушева А.О. и Крымшамхалова Ю.И. были соединены в одно производство и приняты к производству старшим следователем по особо важным делам Управления по расследованию особо важных дел генеральной прокуратуры РФ старшим советником юстиции Зипунниковым И.И..

22 января 2003 года сроки производства предварительного следствия по уголовному делу в отношении Деккушева А.О. продлены Первым заместителем Генерального прокурора Российской Федерации до 44-х месяцев, то есть до 09 мая 2003 года.

В ходатайстве следователь указывает, что оснований для изменения меры пресечения обвиняемому Деккушеву А.О. не имеется в связи с тем, что по делу необходимо завершить производство назначенной 20 января 2003 года амбулаторной психиатрической судебной экспертизы в отношении обвиняемого Крымшамхалова Ю.И., провести допросы обвиняемых Деккушева А.О. и Крымшамхалова Ю.И. по уточнению их показаний, данных ими в ходе следствия, а также провести (при необходимости) очную ставку между ними, завершить ознакомление обвиняемых Деккушева А.О. и Крымшамхалова Ю.И. с заключениями проведенных по уголовному делу судебных экспертиз (в отношении Деккушева А.О. - около 50 экспертиз, в отношении Крымшамхалова Ю.И. - около 1200 экспертиз), завершить допросы и признания около 150 лиц, пострадавших от террористического акта 8 сентября 1999 г. в доме № 19 по ул. Гурьянова в г. Москве, потерпевшими или гражданскими истцами по делу, а также провести ряд других следственных действий по закреплению собранных по уголовному делу доказательств, после чего Деккушеву А.О. и Крымшамхалову Ю.И. необходимо будет предъявить новые обвинения в полном объеме. По выполнении запланированных следственных действий необходимо будет ознакомить потерпевших и гражданских истцов (свыше 1500 человек), а также обвиняемых Деккушева А.О. и Крымшамхалова Ю.И. и их защитников с материалами уголовного дела в порядке ст.ст. 216 и 217 УПК РФ, после чего составить обвинительное заключение. Для выполнения по уголовному делу всех необходимых следственных действий потребуется не менее 3 месяцев, а срок содержания обвиняемого Деккушева А.О. под стражей истекает 09 февраля 2003 года. Оснований для изменения или отмены меры пресечения в виде заключения под стражу - избранной в отношении Деккушева А.О., не имеется, поскольку Деккушев А.О., может скрыться от органов предварительного следствия и суда, продолжить заниматься преступной деятельностью, а также угрожать свидетелям и потерпевшим, и иным...

• Proceedings on September 09, 2002 from criminal case No. 103, initiated on September 13 and 16, 1999 on the facts of explosions in residential buildings in Moscow and Volgodonsk, Rostov region.

• On November 19, 1999, a resolution was issued against Adam Dekkushev to bring him as an accused under Part 3 of Art. 205, Part 3 of Art. 222 of the Criminal Code of the Russian Federation.

• On November 19, 1999, the deputy head of the 3rd department of the Investigation Department of the FSB of the Russian Federation, Rozanova A.A., issued a resolution on the selection of a preventive measure in the form of detention against Adam Dekkushev.
• On July 14, 2002, Adam Dekkushev was detained by law enforcement agencies of the Republic of Georgia on the territory of this state and handed over to the Russian Federation. On the same day, he was charged and a preventive measure in the form of detention was selected.
• On September 13, 2002, the Lefortovo District Court of Moscow extended the period of detention of the accused Adam Dekkushev to 3 months and 26 days, that is, until November 09, 2002.
• On November 04, 2002, the Basmanny District Court of Moscow extended the period of detention of the accused Adam Dekkushev to 6 months and 26 days, that is, until February 09, 2003.
• On January 14, 2003, the criminal cases against Adam Dekkushev and Yusuf Krymshamkhalov were joined into one proceeding and accepted for production by the senior investigator for particularly important cases of the Department for Investigation of Particularly Important Cases of the Prosecutor General's Office of the Russian Federation, Senior Counselor of Justice Zipunnikov I.I.
• On January 22, 2003, the terms of the preliminary investigation in the criminal case against Adam Dekkushev were extended by the First Deputy Prosecutor General of the Russian Federation to 44 months, that is, until May 09, 2003.

In the petition, the investigator indicates that there are no grounds for changing the preventive measure for the accused Adam Dekkushev due to the fact that it is necessary to:
* Complete the outpatient psychiatric forensic examination scheduled for January 20, 2003 in relation to the accused Yusuf Krymshamkhalov.
* Conduct interrogations of the accused Adam Dekkushev and Yusuf Krymshamkhalov to clarify their testimony given during the investigation.
* Conduct (if necessary) a confrontation between them.
* Complete the familiarization of the accused Adam Dekkushev and Yusuf Krymshamkhalov with the conclusions of the forensic examinations conducted in the criminal case (for Adam Dekkushev - about 50 examinations, for Yusuf Krymshamkhalov - about 1200 examinations).
* Complete the interrogations and recognition of about 150 persons who suffered from the terrorist act of September 8, 1999 in house No. 19 on Guryanova St. in Moscow as victims or civil plaintiffs in the case.
* Conduct a number of other investigative actions to consolidate the evidence collected in the criminal case, after which Adam Dekkushev and Yusuf Krymshamkhalov will need to be presented with new charges in full.

Upon completion of the planned investigative actions, it will be necessary to familiarize the victims and civil plaintiffs (over 1500 people), as well as the accused Adam Dekkushev and Yusuf Krymshamkhalov and their defense lawyers with the materials of the criminal case in accordance with Articles 216 and 217 of the Code of Criminal Procedure of the Russian Federation, after which an indictment will be drawn up. To perform all necessary investigative actions in the criminal case, at least 3 months will be required, and the period of detention of the accused Adam Dekkushev expires on February 09, 2003.
