On November 19, 1999, rulings were issued in the case to charge A.O. Dekkushev as an accused under Part 3 of Art. 205 and Part 3 of Art. 222 of the Criminal Code of the Russian Federation, to select a preventive measure in the form of detention, and to declare him wanted.

On July 14, 2002, A.O. Dekkushev was detained by law enforcement agencies of the Republic of Georgia on the territory of that state and, in accordance with the 1993 Minsk Convention of the CIS countries, was handed over to the Russian Federation. On the same day, A.O. Dekkushev was charged, and detention was chosen as the preventive measure against him.

A.O. Dekkushev is accused of the fact that in August-September 1999, as part of an organized criminal group, he illegally acquired, stored, and transported explosives and explosive devices by motor transport from the territory of the North Caucasus to Moscow, where then on September 8 and 13, 1999, using these explosives, he carried out terrorist acts - explosions in residential buildings No. 19 on Guryanova St. and No. 6 building 3 on Kashirskoye Highway, as a result of which 223 people died and more than 150 people received injuries of varying degrees of severity, and significant material damage was caused to the state and citizens.

In addition, sufficient evidence has been collected in the criminal case regarding the direct participation of A.O. Dekkushev in the implementation, as part of the above-mentioned organized criminal group, of the terrorist act of September 16, 1999, in the city of Volgodonsk - an explosion in the courtyard of house No. 35 on Oktyabrskoye Highway, as a result of which 19 people died and over 1000 people received bodily injuries of varying degrees of severity, and significant material damage was caused to the state and citizens.

To investigate the case in full, it is necessary to:
* Complete the forensic biological examination of the clothing of the accused A.O. Dekkushev, seized in September 1999 at his place of residence in Kislovodsk.
* Complete the familiarization of the accused A.O. Dekkushev with the conclusions of the forensic examinations conducted in the criminal case (about 50 examinations).
* Complete the process of recognizing about 100 persons affected by the terrorist act of September 16, 1999, in Volgodonsk as victims or civil plaintiffs in this criminal case.
* Conduct a number of other investigative actions to consolidate the evidence collected in the case, after which A.O. Dekkushev will need to be charged in full.

Upon completion of the planned investigative actions, it will be necessary to familiarize the victims and civil plaintiffs (over 1500 people), as well as the accused A.O. Dekkushev and his defense counsel, with the materials of the criminal case in accordance with Articles 216 and 217 of the Code of Criminal Procedure of the Russian Federation, after which an indictment will be drawn up.

At least 3 months will be required to perform all necessary investigative actions in the criminal case.

The term of detention of the accused A.O. Dekkushev expires on November 9, 2002; however, there are no grounds for changing this preventive measure against him, as he may:
* Hide from the preliminary investigation and the court.
* Continue to engage in criminal activity.
* Threaten witnesses and victims and otherwise obstruct the proceedings in the criminal case.

Based on the foregoing, guided by Art. 109 of the Code of Criminal Procedure of the Russian Federation,

To petition the court, the Basmanny District Court of Moscow (name of the court) to extend the period of detention of the accused Adam Osmanovich Dekkushev (last name, first name, patronymic) in detention in criminal case No. 18/230300-02 for 3 months ___ days, for a total of 6 months 26 days, i.e., until February 9, 2003, inclusive.
