Decision on Extension of Detention

Court Proceedings

  • In the court session, the motion to initiate a petition before the court to extend the period of detention for the accused Adam Dekkushev was supported by the senior prosecutor of the department for supervision of the investigation of especially important cases of the General Prosecutor's Office of the Russian Federation, Yu.I. Ivanova.
  • Having examined the case materials and heard the opinions of the accused and the defense counsel, the court finds the submitted motion subject to satisfaction.

Case History

  • The present criminal case against Adam Dekkushev was separated into separate proceedings on September 09, 2002, from criminal case No. 103, initiated regarding the facts of explosions in residential buildings in the city of Moscow and Volgodonsk, Rostov Region, in 1999.
  • On November 19, 1999, with the sanction of the Deputy Prosecutor General of the Russian Federation A.A. Rozanov, the deputy head of the 3rd department of the Investigative Directorate of the FSB of Russia, Chaika, issued a resolution on the application of a measure of restraint in the form of detention against Adam Dekkushev.
  • On November 19, 1999, a resolution was issued against Adam Dekkushev to bring him as an accused under Art. 205 part 3, 222 part 3 of the Criminal Code of the Russian Federation, which was announced to Adam Dekkushev on July 14, 2002.
  • On September 13, 2002, by a resolution of a judge of the Lefortovo District Court of Moscow, the period of detention of Adam Dekkushev was extended to three months and 26 days, that is, until November 09, 2002.

Court Consideration

Ruling

Based on the foregoing and guided by Art. 109 of the Code of Criminal Procedure of the Russian Federation, the judge

r e s o l v e d:

  • To extend the period of detention of the accused Adam Osmanovich Dekkushev, born February 03, 1962, a native of the city of Karachaevsk, a citizen of the Russian Federation, registered at the address: Karachaevsk, Lenin Street, house 75, for 3 months, for a total of 6 months and 26 days, that is, until February 09, 2003.

This resolution may be appealed to the Moscow City Court within 10 days from the date of its issuance.
