INDICTMENT

in criminal case No. 970

Charging Anatoly Viktorovich Mylnikov with the commission of crimes provided for by Part 1 of Art. 205, Part 3 of Art. 30, and Part 4 of Art. 150 of the Criminal Code of the Russian Federation.

This criminal case was initiated on July 18, 2000, by the Investigative Service of the UFSB of the RF for Moscow and the Moscow Region on the grounds of a crime provided for by Art. 207 of the Criminal Code of the RF.

The grounds for initiating the criminal case were materials from an investigation by the operational unit of the UFSB of the RF for Moscow and the Moscow Region regarding the receipt on August 21 at the Prosecutor General's Office of the RF and on September 7, 1999, at the editorial office of the mass media outlet "Novaya Gazeta" of written appeals on behalf of the so-called "Volunteers of Russia," containing a demand to the authorities to release N.V. Zander, who had been arrested by the Ministry of Internal Affairs (MVD), and a threat that "...otherwise, every 7 days, communications, buildings, etc., will be blown up." Operational-search activities established the author of the text and the sender of the appeals — a resident of Moscow, Anatoly Viktorovich Mylnikov, born in 1946, a native of Ivano-Frankivsk, Russian, a citizen of the RF, who worked as the head of the economic security service of CJSC "Zolotye Stranitsy" [Golden Pages], previously convicted multiple times, including for the commission of especially grave crimes. This information was confirmed by a statement from a resident of Moscow, A.E. Tumasyan, who contacted the UFSB of the RF for the Moscow Region on May 19, 2000, in which she identified A.V. Mylnikov as the author of the text of the "Appeal" and its sender to various organizations. She confirmed the circumstances of this crime during the preliminary investigation.

During the establishment of the circumstances of the committed act, A.V. Mylnikov was interrogated; he denied his involvement in the preparation of the "Appeal" and its distribution. After the interrogation at the Investigative Service, he went into hiding and did not respond to summons.

  • On September 12 and November 15, 2000, the term of the preliminary investigation was extended by the Prosecutor of Moscow to 4 and 5 months, respectively.
  • Taking into account the evidence obtained during the preliminary investigation, on November 8, 2000, a resolution was issued to charge (in absentia) A.V. Mylnikov with the commission of a crime provided for by Art. 207 of the Criminal Code of the RF.
  • On November 14, 2000, a resolution was issued for the forced appearance of the accused A.V. Mylnikov.
  • On December 18, 2000, a resolution was issued to suspend the preliminary investigation and to search for the accused A.V. Mylnikov on the basis of Clause 1 of Art. 195 of the Code of Criminal Procedure of the RSFSR.
  • On December 19, 2001, a resolution was issued to resume the suspended preliminary investigation and to file a motion to establish a term for the investigation of the case until January 19, 2002.

Case Summary

  • On January 15, 2002, A.V. Mylnikov was brought to the Investigative Service, where he was charged with committing a crime under Art. 207 of the Criminal Code of the Russian Federation, and a preventive measure in the form of detention was chosen.
  • On January 18, March 7, and May 8, 2002, the period of the preliminary investigation was extended by the Deputy Prosecutor General of the Russian Federation to seven months and twenty-four days, to nine months and twenty-three days, and to ten months and twenty-three days, respectively.
  • On March 1 and April 26, 2002, the period of detention for the accused Mylnikov was extended by the Prosecutor of Moscow to 4 and 5 months, respectively.

Preliminary Investigation Findings

The preliminary investigation established that in the summer of 1999, at the apartment of N.V. Zander at the address: Moscow, Svobodny Prospekt, 28, apt. 82, who was in custody at that time in connection with criminal prosecution, A.V. Mylnikov, in the presence of his subordinate—a freelance employee of the security service of the "Zolotye Stranitsy" [Golden Pages] publishing house, the minor A.E. Tumasyan—personally prepared the handwritten text of an "Appeal" on behalf of the so-called "Volunteers of Russia," in which a demand was made to the authorities to release N.V. Zander, who had been arrested by the MVD bodies, and a threat was expressed—"communications, buildings, etc. will be blown up" every 7 days if the above demand was not met by September 1, 1999. He handed the text of the said "Appeal" to A.E. Tumasyan and persuaded her to prepare letters addressed to the Prosecutor General's Office of the Russian Federation and the editorial office of "Novaya Gazeta." At the same time, he instructed her on the procedure for preparing the letters: type the text on a personal computer belonging to one of her acquaintances, destroy the file with the text, and have the addresses on the envelopes written by outsiders, preferably random persons.

A.E. Tumasyan, having produced, according to the recommendations received from A.V. Mylnikov, an unidentified number of printed copies of the "Appeal" on the PC of M.M. Neudakhina at the latter's place of residence at the address: Moscow, Kravchenko St., 12, apt. 331, placed them in mailing envelopes; the addresses of the recipients on them were written at her request by unidentified teenagers, after which she handed them to A.V. Mylnikov, some of which he sent by mail in late August 1999 to the addresses of the Prosecutor General's Office of the Russian Federation and the editorial office of "Novaya Gazeta." A.E. Tumasyan handed over the handwritten text of the "Appeal" executed by A.V. Mylnikov, along with her statement, to the UFSB of the RF for Moscow and the Moscow Region.¹

Case Summary

In view of the above, on April 25, 2002, A.V. Mylnikov was presented with a new charge of committing crimes provided for by Part 1 of Art. 205, Part 3 of Art. 30, and Part 4 of Art. 150 of the Criminal Code of the Russian Federation.

Regarding the charges presented, A.V. Mylnikov did not plead guilty and declared his non-involvement in the crimes incriminated against him. At the same time, being interrogated, he confirmed the fact of his acquaintance with N.V. Zander and A.E. Tumasyan and testified that the proposal to take measures for the release of N.V. Zander by sending an anonymous letter of an ultimatum nature came to him from A.E. Tumasyan. She did not inform him where she intended to send this letter, and he does not remember the direct circumstances of its production.

Evidence of Unlawful Activity

The unlawful activity of the accused A.V. Mylnikov in the full scope of the charges brought against him is confirmed by the evidence collected in the case:

Witness testimonies:
  • A.E. Tumasyan: Stated that in the summer of 1999, at the apartment of N.V. Zander, who was in custody at that time in connection with criminal prosecution, A.V. Mylnikov suggested she type a text he had prepared, containing a demand to release his acquaintance N.V. Zander as an innocently suffering mother of minor children, promising at the same time that, in case of trouble, he would "take it upon himself" and assured her that as a minor, she was not in any danger. After which he handed over the handwritten text of the "Appeal", the addresses of the General Prosecutor's Office of the RF and the editorial office of "Novaya Gazeta" and instructed her on the procedure for preparing the letters: typing and printing the text on a computer belonging to one of her acquaintances, deleting the file from which the printout was made, and having the addresses on the envelopes written by outsiders, preferably random persons. Being at that time a freelance employee of the security service of the "Golden Pages" publishing house and a subordinate of A.V. Mylnikov, and also being under the influence of his story about the need to help an unfortunate woman, Tumasyan could not refuse his request and produced several printed copies of the "Appeal" on the PC of her friend M.M. Neudakhina at the latter's place of residence. Having placed them in mailing envelopes, on which the recipient addresses were written at her request by unknown teenagers, she handed them over to A.V. Mylnikov. She kept the handwritten text of the appeal for herself, and then, together with her statement, handed it over to the UFSB RF for Moscow and the Moscow Region.
    • Regarding the circumstances of her personal acquaintance with N.V. Zander, A.E. Tumasyan testified that it occurred in January 2000 after the latter was released from custody.

Mylnikov in January 1999, living together with him until her arrest on July 8 of the same year, and the measures he subsequently took for her release, in particular appeals to the mass media, with the aim of, if not achieving a change in her preventive measure, then raising her authority in places of deprivation of liberty in case of conviction.

Testimony Regarding the "Appeal"

Regarding the circumstances of the dispatch by A.V. Mylnikov of the "Appeal" on behalf of the so-called "Volunteers of Russia," N.V. Zander testified that she learned about this from A.E. Tumasyan, who in the spring of 2000 informed her of A.V. Mylnikov's request in August 1999 to produce several printed copies of the "Appeal." For this, he provided her with:

  • A handwritten text of the document.
  • A list of addresses.
  • Several mailing envelopes.

He also instructed her on observing precautionary measures, including:

  • Using someone else's computer.
  • Not saving the file with the text.
  • Having the addresses on the mailing envelopes written by strangers, such as children playing in the yard.

N.V. Zander carried out these instructions. At that same time, A.E. Tumasyan showed N.V. Zander the handwritten text of the "Appeal." After reviewing it, N.V. Zander concluded that it had been prepared specifically by A.V. Mylnikov because:

  • She was familiar with his handwriting and writing style.
  • The text was written with a black gel pen, which A.V. Mylnikov liked to use for writing.

She then advised A.E. Tumasyan to take this appeal to the competent authorities.

Regarding the time of her acquaintance with A.E. Tumasyan, N.V. Zander explained that it occurred after she started working at "Zolotye Stranitsy" in February 2000.

Assessing this appeal by Mylnikov A.V. as an attempt to use the tragedy that occurred on Manezhnaya Square to release his acquaintance, she refused to print material in defense of Zander N., also believing that unknown persons, instead of transmitting threats through Mylnikov A.V., could have expressed them directly to representatives of the authorities.

Mylnikov, and his writing of the handwritten text of the "Appeal";

by the act of the V.P. Serbsky State Scientific Center for Social and Forensic Psychiatry No. 198/a stating that A.V. Mylnikov should currently be considered sane.

Case Summary

On January 14, 2000, a verdict was issued and proclaimed in the case, according to which N.V. Zander was found guilty of committing a crime under Part 5 of Article 33 – Paragraph 'b' of Part 3 of Article 164 of the Criminal Code of the Russian Federation and sentenced to imprisonment, and upon serving the term, she was released from custody in the courtroom.

Regarding the 'Appeal' on behalf of the so-called 'Volunteers of Russia,' this letter states that such an appeal was indeed received by the court from the Prosecutor General's Office of the Russian Federation on September 8, 1999, in connection with which, and also taking into account the situation that had developed at that time in Moscow, the court administration took measures to strengthen its security during the days of court hearings in the case of N.V. Zander and others.

The strengthening of the security of the court building during the period of consideration of the above-mentioned case testifies to the fact that the threat of terrorist acts expressed in the 'Appeal' was assessed as real, in connection with which the above-mentioned preventive measure was carried out.

  • By a letter from a department of the Prosecutor General's Office of the Russian Federation, from which it follows that the appeal, which mentioned the criminal case against N.V. Zander, was received by the Prosecutor General's Office of the Russian Federation by mail. The conclusion that the mentioned appeal refers to the threat of terrorist acts was made based on its content: '...communications, buildings, etc. will be blown up,' in connection with which a decision was made to forward the letter to the FSB of the Russian Federation.

The forwarding by the Prosecutor General's Office of the Russian Federation and the editorial office of 'Novaya Gazeta' of the received 'Appeals' with the threat of terrorist acts to the Federal Security Service of the Russian Federation – the body which, in accordance with current federal legislation, is tasked with the fight against terrorism – testifies to the fact that the threat expressed in the 'Appeals' was perceived by their representatives as real and forwarded for further verification by jurisdiction.

The appeal of Tumasyan A.E.

The appeal of Tumasyan A.E. dated May 19, 2000, to the FSB RF bodies with a corresponding statement confirms the testimony of Zander N.V. regarding a conversation that took place between them in the spring of 2000 about the circumstances of preparing and sending an "Appeal" in her defense, as well as the fulfillment by Tumasyan A.E. of the recommendation given by Zander N.V.—to contact the competent authorities.

  • By a copy of the sentence dated January 14, 2000, of the Ostankino Inter-municipal (District) People's Court of the city of Moscow on the charges against Zander N.V. for committing crimes provided for by parts 4 and 5 of Art. 33 – para. "b" part 3 of Art. 163 of the Criminal Code of the RF, as well as Zander A.S. and Marchenko V.V., from which it follows that Zander N.V. was found guilty by the said court of committing the act incriminated to her and was sentenced, with the application of Art. 64 of the Criminal Code of the RF, to imprisonment for a term of 6 (six) months without confiscation of property, to be served in a general regime correctional colony. Her sentence term was calculated including the time of preliminary detention from July 8, 1999, and the measure of restraint before the sentence entered into legal force was changed, and upon serving the sentence, Zander N.V. was released from custody in the courtroom.

By the same sentence, he was recognized as a recidivist.
