Considering the circumstances, and also considering the gravity of the crimes committed, of which Krymshamkhalov Yu.I. and Dekkushev A.T. are accused, the court finds no grounds for changing their preventive measure.

Based on the foregoing and guided by Articles 227, 231 of the Criminal Procedure Code of the RF, the judge

DECIDED:

  • To schedule an open court session for the criminal case against Krymshamkhalov Yusuf Ibragimovich, accused of committing crimes provided for by Articles 205 part 3, 208 part 2, 222 part 3, 223 part 3, 105 part 2 items "a", "e", "zh", "z", "n", 30 part 3 and 105 part 2 items "a", "e", "zh", "z", "n", 322 part 2 of the Criminal Code of the RF, and Dekkushev Adam Tuganovich, accused of committing crimes provided for by Articles 205 part 3, 208 part 2, 222 part 3, 223 part 3, 105 part 2 items "a", "e", "zh", "z", "n", 30 part 3 and 105 part 2 items "a", "e", "zh", "z", "n" of the Criminal Code of the RF, in the premises of the Moscow City Court on October 31, 2003, at 11:00 AM.
  • The preventive measure for Krymshamkhalov Yu.I. and Dekkushev A.T. shall remain the same - detention in custody.

ESTABLISHED:

The criminal prosecution authorities accuse A.O. Dekkushev of committing crimes provided for by Part 3 of Art. 205 of the Criminal Code of the Russian Federation and Part 3 of Art. 222 of the Criminal Code of the Russian Federation, namely: in August - September 1999, acting as part of an organized criminal group that planned to commit a series of acts of terrorism in Moscow, together with A.Sh. Gochiyayev, D.F. Saitakov, T.A. Batchayev, Yu.I. Krymshamkhalov and a number of other persons, he delivered by motor transport from the territory of the North Caucasus and placed in non-residential premises in the city of Moscow at the addresses: Borisovskie Prudy St., house No. 16 bldg. 2 and Krasnodarskaya St., house No. 70 about 12 tons of homemade explosives with means of detonation. After that, during September 7-8 of the same year, A.O. Dekkushev, with the help of the same accomplices, removed two batches of explosives from the specified warehouses to the selected locations of the planned acts of terrorism, in non-residential premises rented for this purpose in houses No. 19 on Guryanova St. and house No. 6, bldg. 3 on Kashirskoye Highway, Moscow. On September 8 and 13, 1999, using the specified explosive devices, A.O. Dekkushev, together with A.Sh. Gochiyayev, D.F. Saitakov, T.A. Batchayev, Yu.I. Krymshamkhalov and other members of the group, carried out the explosions of these two apartment buildings, together with the citizens living in them, as a result of which 223 people died, more than 150 residents received injuries of varying degrees of severity, and the houses were destroyed. By these actions, A.O. Dekkushev, having carried out as part of an organized group the explosions of two residential buildings in Moscow, caused significant property damage and resulted in the death of a large number of people.

At the same time, A.O. Dekkushev, by his actions as part of an organized group, committed the illegal acquisition, storage and transportation of explosives and explosive devices used in the acts of terrorism committed in Moscow on September 8 and 13, 1999, and prepared for the implementation of planned similar crimes.

In addition, evidence has been collected in the criminal case regarding the direct participation of A.O. Dekkushev in the implementation as part of the above-mentioned organized criminal group

However, there are no grounds for changing this preventive measure in respect of him, as he may abscond from the preliminary investigation and the court, continue to engage in criminal activity, as well as threaten witnesses and victims and otherwise obstruct the proceedings in the criminal case.

On the basis of the foregoing, guided by Art. 109 of the CCP of the RF,

Regarding the fact of the explosion in residential building No. 19 on Guryanova St. in Moscow on September 9, 1999, criminal case No. 275209 was initiated. On September 13, 1999, criminal cases No. 275210 were initiated regarding the fact of the explosion in residential building No. 6, building 3 on Kashirskoye Highway in Moscow, and No. 75908 in connection with the discovery at the address: Moscow, Borisovskie Prudy St., house 16, building 2, of an explosive substance of the "ammonal" type weighing about 1000 kg, as well as electric detonators, intermediate detonators, and fuzes with a clock mechanism. On September 22, 1999, the above-mentioned criminal cases were merged into a single proceeding under No. 103.
On September 16, 1999, criminal case No. 173 was initiated regarding the fact of the explosion in the courtyard of residential building No. 35 on Oktyabrskoye Highway in Volgodonsk, Rostov Region. On August 8, 2002...

ESTABLISHED:

  • In August-September 1999, A.O. Dekkushev, acting as part of an organized group that planned to commit a series of acts of terrorism in the city of Moscow, together with A.Sh. Gochiyayev, D.F. Saitakov, T.A. Batchayev, Yu.I. Krymshamkhalov, and a number of other persons, delivered by motor transport from the territory of the North Caucasus and placed in non-residential premises in the city of Moscow at the addresses: Borisovskiye Prudy Street, house 16, building 2, and Krasnodarskaya Street, house 70, about 12 tons of clandestinely manufactured explosive substances with means of detonation.
  • After which, during September 7-8, 1999, A.O. Dekkushev, with the help of the same accomplices, removed two batches of explosive substances from the specified warehouses to the selected locations of the planned acts of terrorism in non-residential premises rented for this purpose in houses No. 19 on Guryanova Street and No. 6 on Kashirskoye Shosse.
  • On September 8 and 13, 1999, using the specified devices, A.O. Dekkushev, together with Gochiyayev, Saitakov, Batchayev, Krymshamkhalov, and other accomplices, carried out the explosions of the specified houses along with the citizens living in them, as a result of which 223 people died, more than 150 residents received injuries of varying degrees of severity, and the houses were destroyed.

In the petition to initiate before the court a motion to extend the period of detention for A.O. Dekkushev, Senior Investigator of the General Prosecutor's Office I.I. Zipunnikov indicates that the preliminary investigation of the criminal case cannot be completed within the established timeframe, since it is necessary to:

  • Complete the forensic biological examination of A.O. Dekkushev's clothing.
  • Complete the familiarization of the accused A.O. Dekkushev with the conclusions of the conducted forensic examinations.
  • Complete the process of recognizing about 100 persons affected by the terrorist act of September 16, 1999, in the city of Volgodonsk as victims and civil plaintiffs.

  • During the investigation of the criminal case, it was established that the terrorist acts — explosions in residential buildings in the cities of Moscow and Volgodonsk in September 1999 — were committed by an organized criminal group, whose members were leaders and participants of illegal armed formations on the territory of the Chechen Republic: Emir Ibn Al-Khattab, Abu Al-Walid Al-Hamidi, Gochiyayev A.Sh., Saitakov D.F., Krymshamkhalov Yu.I., Batchaev T.A., Abaev Kh.M., Dekkushev A.O., and a number of other persons not identified by the investigation.

established:

  • From the submitted motion and the materials presented to the court, it appears that on July 14, 2002, A.O. Dekkushev, who was on the wanted list, was detained and extradited from Georgia to Russia.
  • On the same day, based on resolutions dated November 19, 1999, he was charged with committing acts of terrorism in Moscow in September 1999 under Part 3 of Art. 205 and Part 3 of Art. 222 of the Criminal Code of the Russian Federation, and a preventive measure in the form of detention was applied.
  • Interrogated on the merits of the especially grave crimes incriminated against him, Dekkushev pleaded guilty to committing them together with Yu.I. Krymshamkhalov, T.A. Batchaev, Z.A. Batchaev, A.Sh. Gochiyaev, and other persons, and gave detailed testimony about the circumstances of the execution of the order received from the leaders of bandit formations to commit acts of terrorism in the cities of Moscow and Volgodonsk in September 1999.
  • The guilt of A.O. Dekkushev in committing the aforementioned crimes is fully confirmed by the totality of the evidence collected in the case.

The prosecutor and the investigator supported the submitted motion to extend the period of detention of A.O. Dekkushev to 3 months and 26 days, i.e., until November 9, 2002, since it is necessary to perform investigative actions in the case:

  • To present him with the full charges.
  • To interrogate him on all episodes of the incriminated acts.
  • To familiarize the accused, his defense counsel, and the victims with the materials of the criminal case, the volume of which is more than 40 volumes.
  • To prepare the indictment and send it to the Prosecutor General's Office of the Russian Federation, in connection with which an additional period of detention for the accused Dekkushev will be required.

According to the aforementioned motion, the preventive measure in the form of detention against A.O. Dekkushev was not appealed, and it is inappropriate to change it, as it was chosen due to the gravity of the charge.

Lawyer N.I. Tarasevich and the accused A.O. Dekkushev have no objections to the submitted motion.

In addition, I plead guilty to the fact that, as part of an organized group, I committed an act of terrorism — the bombing of a residential building on September 16, 1999, in the city of Volgodonsk, that is, to the commission of a crime provided for by Part 3 of Art. 205 of the UK RF. I want to clarify that initially I did not want to blow up a residential building, I did not want such grave consequences. When I met with Abu Umar in Chechnya at the end of August 1999, he told me that the explosive substance that Achimez Gochiyaev did not take should be taken to the cities of Rostov and Krasnodar and blown up there in the markets. According to him, this should be done so that Russia would not go to war in Chechnya, since at that time there were already combat clashes between the Russian Army and Khattab's militants in Dagestan.
