DECREE

on bringing a new charge

April 24, 2002

Investigator of the Investigative Service of the FSB Directorate of the Russian Federation for the city of Moscow and Moscow Region, Captain of Justice Asochakov I.V., having examined the materials of criminal case No. 970, regarding the charge against Mylnikov A.V., born 1946, for committing a crime provided for by Art. 207 of the Criminal Code of the Russian Federation. -

ESTABLISHED:

  • In 2002, Mylnikov A.V. was charged in this criminal case with committing a crime provided for by Art. 207 of the Criminal Code of the Russian Federation.
  • In the course of the preliminary investigation, sufficient evidence was collected, providing the grounds for changing the charge brought, supplementing it and bringing against Mylnikov Anatoly Viktorovich a new charge of terrorism, i.e., the threat of committing explosions and other actions creating a danger of death to people and causing significant property damage, for the purpose of violating public safety, intimidating the population and influencing decision-making by government bodies, and for attempting to involve a minor in the commission of a serious crime.

  • In August 1999 in Moscow, Mylnikov A.V., for the purpose of violating public safety, intimidating the population and influencing decision-making by government bodies, committed an act of terrorism in the form of a threat of committing explosions and other actions creating a danger of death to people and causing significant property damage, by presenting to the government bodies demands for the release from custody of the accused Zander N.V., detained by the bodies of the Ministry of Internal Affairs on July 8, 1999, expressed in sending by mail to the General Prosecutor's Office of the Russian Federation and to the editorial office of "Novaya Gazeta" letters with the heading "Demands", executed on behalf of the so-called organization "Volunteers of Russia", in which there was a threat to blow up buildings and communications of Moscow and the regions in case of non-fulfillment of the requirements by September 1, 1999, for conveying the specified information to government bodies authorized to make a decision regarding Zander N.V. on release from custody, for the purpose of intimidating them and influencing government bodies, - committed a crime provided for by Part 1 of Art. 205 of the Criminal Code of the Russian Federation.

Resolution

To accuse Mylnikov Anatoly Viktorovich, born in 1946, a native of the city of Ivano-Frankivsk, Russian, a citizen of Russia, previously repeatedly convicted, head of the economic security service of the "Golden Pages" publishing house, registered at the address: Moscow, Sadovaya-Karetnaya St., 4/6, apt. 82, with a new charge of committing crimes provided for by Part 1 of Art. 205, Part 3 of Art. 30 and Part 4 of Art. 150 of the Criminal Code of the Russian Federation, of which he is to be notified.

  • Have a defender from the moment the charge is brought, and in case of detention or the application of a measure of restraint in the form of detention before the charge is brought

Rights of the Accused

  • From the moment of the announcement to me of the detention protocol or the decree on this measure;
  • To participate in the judge's consideration of complaints in the manner provided by Art. 220-2 of the CCP of the RSFSR;
  • To participate in the court proceedings in the first instance;
  • To challenge officials;
  • To file complaints against the actions and decisions of the investigator, prosecutor, and court;
  • To defend one's rights and legal interests by any means and methods not contrary to the law, as well as the right to a final word as a defendant.
