Обстоятельства, смягчающие ответственность обвиняемого Мыльникова А.В. в ходе следствия не получено.
Отягчающим вину обстоятельством следствие считает рецидив преступлений.

Мыльников Анатолий Викторович, 1946 г.р., уроженец г. Ивано-Франковска, русский, гражданин России, ранее неоднократно судимый, начальник службы экономической безопасности издательского дома "Золотые страницы", зарегистрированный по адресу: г.Москва ул. Садовая-Каретная, д.4/6, кв. 82

в терроризме, т.е. угрозе совершения взрывов и иных действий, создающих опасность гибели людей и причинения значительного имущественного ущерба, в целях нарушения общественной безопасности, устрашения населения и оказания воздействия на принятие решения органами власти и в покушении на вовлечение несовершеннолетнего в совершение тяжкого преступления.

Терроризм, т.е. угроза совершения взрывов и иных действий, создающих опасность гибели людей и причинения значительного имущественного ущерба, в целях нарушения общественной безопасности, устрашения населения и оказания воздействия на принятие решений органами власти.

В конце августа 1999 года в г.Москве Мыльников А.В. в целях нарушения общественной безопасности, устрашения населения и оказания воздействия на принятие решений органами власти совершил акт терроризма в форме угрозы совершения взрывов и иных действий, создающих опасность гибели людей и причинения значительного имущественного ущерба, путем предъявления органам власти требований об освобождении из-под стражи обвиняемой Зандер Н.В., арестованной органами МВД 8 июля 1999 года, выразившихся в направлении по почте в адрес Генеральной прокуратуры РФ и в адрес редакции «Новой газеты» писем с текстом «Обращения», исполненного от имени т.н. организации «Добровольцы России», в котором содержалась угроза совершения взрывов зданий и коммуникаций через каждые 7 дней в случае неисполнения требований до 1 сентября 1999 года, для доведения указанной информации органам власти, полномочным принять в отношении Зандер решение об освобождении из под стражи, в целях их устрашения и оказания воздействия на органы власти, -
то есть совершил преступление, предусмотренное ч. 1 ст. 205 УК РФ.

Покушение на вовлечение несовершеннолетнего в совершение тяжкого преступления.

В конце августа 1999 года в г.Москве Мыльников А.В., 1946 г.р., достоверно зная о несовершеннолетнем возрасте Тумасян А.Э., 25.09.82 г.р., путем обмана и оказания на нее психологического воздействия покушался на вовлечение ее в совершение тяжкого преступления - акта терроризма, предусмотренного ч.1 ст.205 УК РФ, изготовив с её помощью на компьютере печатные тексты собственноручно

Terrorism, i.e., the threat of carrying out explosions and other actions that create a danger of loss of life and causing significant property damage, for the purpose of disrupting public safety, intimidating the population, and influencing decision-making by government authorities.

In late August 1999, in Moscow, A.V. Mylnikov, for the purpose of disrupting public safety, intimidating the population, and influencing decision-making by government authorities, committed an act of terrorism in the form of a threat to carry out explosions and other actions creating a danger of loss of life and causing significant property damage, by presenting demands to government authorities for the release from custody of the accused N.V. Zander, arrested by Ministry of Internal Affairs (MVD) bodies on July 8, 1999, which manifested in sending by mail to the General Prosecutor's Office of the Russian Federation and to the editorial office of "Novaya Gazeta" letters with the text of an "Appeal," executed on behalf of the so-called organization "Volunteers of Russia," which contained a threat to carry out explosions of buildings and communications every 7 days in case of non-fulfillment of the demands by September 1, 1999, for the purpose of conveying said information to government authorities authorized to make a decision regarding Zander's release from custody, for the purpose of intimidating them and influencing government authorities.

• That is, he committed a crime provided for by Part 1 of Art. 205 of the Criminal Code of the Russian Federation.

Tumasyan, born 25.09.82, through deception and psychological influence on her, attempted to involve her in the commission of a serious crime - an act of terrorism provided for by Part 1 of Art. 205 of the Criminal Code of the Russian Federation, having produced with her help on a computer printed texts [of his] own.
