Suspect Lyubichev S.S. has been informed that he is suspected of the following:

  • In August 1999, while being an official, using his official powers contrary to the interests of the service, acting out of mercenary interest, he ensured the unhindered passage into the territory of the city of Kislovodsk of a 'Kamaz' vehicle that was in a technically faulty condition.
  • The driver of this vehicle did not have accompanying documents for the transported cargo, which contained a homemade explosive substance disguised with bags of sugar.
  • He personally escorted it to the warehouses of 'Realbaza khleboproduktov' [Realbase of Grain Products], located on Zheleznodorozhnaya St. in the city of Kislovodsk, for which he received an illegal reward in the form of 1 bag of sugar.

The actions of Lyubichev S.S. resulted in a significant violation of the rights and legitimate interests of citizens and the interests of society and the state protected by law, as well as grave consequences, since as a result of the implementation of acts of terrorism using this explosive substance on September 8, 13, and 16, 1999, in the cities of Moscow and Volgodonsk, 244 people died; about 30 people were wounded, three residential multi-story buildings were destroyed, and material damage amounted to more than 310 million rubles, that is, in the commission of a crime provided for by Part 3 of Art. 285 of the Criminal Code of the Russian Federation.

Statement Regarding Suspicion

Regarding the substance of the suspicion, I can state the following:

  • In September 1999, when I worked in the position of state inspector of road supervision of the OGIBDD of the Kislovodsk GOVD, after the explosion of a residential building in the city of Volgodonsk, we received lookouts for persons wanted for the commission of terrorist acts in the cities of Moscow and Volgodonsk.
  • Seeing photographs of Yusuf Krymshamkhalov, whom I had known previously, and two other persons, I remembered an incident that occurred in August 1999.
  • In August 1999, I do not remember exactly which date, but on a working day, in the period from 2:00 PM to 3:00 PM, I was traveling in a car along Fomenko St. in the city of Kislovodsk in the direction of the exit from the city.
  • I do not remember which car I was driving – either my personal VAZ-21213 license plate E 499 SN 26 region, or a patrol car.
  • Having passed the intersection of Fomenko and Kalinin streets, at a distance of approximately 200 meters from the intersection, I saw a 'Kamaz' vehicle moving towards me.
  • The vehicle attracted my attention because it was visible that it was loaded with something and was moving very slowly.
  • I turned around and caught up with the 'Kamaz' vehicle.
  • I caught up with the vehicle in the area of auto repair shops located in the private sector, to the left of the roadway (if traveling in the direction of the intersection of Kalinin and Fomenko streets from the side of the entrance to the city).
  • The cabin of the 'Kamaz' vehicle was orange; I did not remember the registration plate of this vehicle.
  • Only the driver was in the cabin of the vehicle. He got out of the cabin and walked in my direction.
  • I can describe the driver as follows – of Caucasian nationality, appearing 39-40 years old, hair light-reddish, of thin build, short stature.
  • I stopped my car on the shoulder of the road opposite the 'Kamaz', slightly behind it.
  • I approached the driver of the 'Kamaz', introduced myself, and asked the driver to present documents for the vehicle and the transported cargo.
