Так, 17 ноября 1999 года в городе Кисловодск был задержан гражданин Магаев Руслан Шамельевич, 29.01.64 г.р., карачаевец, уроженец пос. Мирный Предгорного района Ставропольского края, женатый, со средним образованием, временно не работающий, ранее не судим, проживающий по адресу: КЧР, г.Карачаевск, ул. Семенова, д. 10, кв. 36, который на грузовом автомобиле КАМАЗ-53212 гос. номер А 831 АМ 09 перевозил и временно в нем хранил на территории Ставропольского края вместе с Крымшамхаловым, Батчаевым и Деккушевым примененную при взрывах домов в Москве партию взрывчатых веществ.
19 ноября 1999 года на основании собранных по делу доказательств: показаний свидетелей Крымшамхалова М., Карданова, Алиева, Зекеева, Клычева, Погосова, Тишина, осмотром указанного выше транспортного средства и др., ему было предъявлено обвинение по ч. 5 ст. 33, ч. 3 ст. 205 и ч. 3 ст. 222 УК РФ, и в тот же день с санкции Заместителя Генерального прокурора РФ к нему применена мера пресечения в виде заключения под стражу с содержанием в Следственном изоляторе ФСБ России, срок которого 13 января 2000 года продлен до 9 марта сего года.
Кроме того, в ходе экспертных исследований объектов, изъятых при производстве осмотра грузовика Магаева, обнаружены следы бризантных взрывчатых веществ, что объективно подтверждает факт перевозки им указанной выше партии ВВ.
Спланированные и произведенные в продленный срок следственные действия процессуально закрепили доказательства, достаточные для предъявления обвинения по ч. 3 ст. 205 и ч. 3 ст. 222 УК РФ Крымшамхалову, Деккушеву и Батчаеву. 19 ноября прошлого года были вынесены постановления о привлечении их в качестве обвиняемых по уголовному делу № 103 и в отношении них избрана мера пресечения в виде заключения под стражу. Все они объявлены в розыск, организация которого поручена 2 Департаменту ФСБ России.
К настоящему времени получены данные о возможном нахождении разыскиваемых по делу обвиняемых в Чеченской Республике на территории контролируемой незаконными вооруженными формированиями. Ориентировки об их задержании направлены в УФСБ России по ЧР, а также во все территориальные подразделения ФСБ России.
В указанный выше срок следствия был произведен большой объем работы в зоне боевых действий в Чечне во время проведения Федеральным войсками контртеррористической операции: осмотрено несколько баз боевиков, в ходе которых изъяты образцы взрывчатых веществ и их смесевых компонентов (их исследованием на предмет схожести с ВВ, примененными при взрывах домов, занимаются специалисты в/ч 34435); в районе города Урус-Мартан установлено место расположения базы одного из главарей чеченского...
