причиненного совершенным преступлением: 487 человек признано потерпевшими, а сумма ущерба составила 310.531.031 рублей.
Кроме того, в соответствии с разработанным ранее планом расследования уголовного дела № 103 произведено свыше 1136 допросов свидетелей, 40 опознаний личностей Гочияева, Сайтакова, Крымшамхалова, Деккушева и Батчаева как лиц, осуществлявших руководство и участвовавших в доставке ВВ к местам его хранения и взрывов, 36 выемок предметов и документов, имеющих значение для дела, 109 осмотров, 80 обысков, 467 экспертиз различного криминалистического профиля (в том числе и судебно-медицинские).
Однако, не смотря на проделанный по делу объем работы, задержать разыскиваемых за совершение расследуемого преступления лиц, пока не представилось возможным.
Наряду с изложенным, по делу запланирован значительный объем следственных действий, предусматривающих:
- продолжение во взаимодействии с органами дознания розыска обвиняемых Гочияева, Сайтакова, Батчаева, Деккушева и Крымшамхалова с целью их задержания и детализации всех обстоятельств совершенного преступления: его организаторах; местах изготовления, расфасовки и хранения примененного ВВ до его доставки на территорию Кавказских Минеральных вод; установке участника ОПГ по имени Хаким, сопровождавшем взрывчатку в город Москву; обстоятельств и способов отъезда участников названной ОПГ из города Москвы после совершения взрывов и т.д.;
- установку и допросы свыше семидесяти свидетелей, обладающих информацией, необходимой для расследования уголовного дела;
- производство 52 осмотров изъятых в ходе следствия материалов и их процессуальное определение;
- дальнейшее производство запланированных в Северо-Кавказском регионе следственных действий по проверке полноты, достоверности и объективности данных обвиняемым Магаяевым показаний и предъявление ему полученных по делу доказательств;
- завершение 15 криминалистических экспертиз и корректировку по их результатам плана работы по делу.
Учитывая особую сложность настоящего уголовного дела и необходимость проведения указанных выше следственных действий и розыскных мероприятий, выполнить которые в оставшийся срок следствия не представляется возможным, а также то, что избранная в отношении обвиняемого Магаяева мера пресечения не может быть изменена по причине тяжести совершенного им преступления и, находясь на свободе, он может скрыться от следствия и суда, либо воспрепятствовать установлению истины по делу, руководствуясь требованиями статей 97 и 133 Уголовно-процессуального кодекса РСФСР,

  • Despite the volume of work performed, it has not yet been possible to detain the persons sought for the commission of the crime under investigation.

Planned Investigative Actions

A significant volume of investigative actions is planned for the case, including:

• Continuation, in cooperation with the inquiry bodies, of the search for the accused Gochiyayev, Saitakov, Batchaev, Dekkushev, and Krymshamkhalov for the purpose of their detention and detailing all the circumstances of the crime committed:
  • Its organizers.
  • Places of manufacture, packaging, and storage of the explosives used prior to their delivery to the territory of the Caucasian Mineral Waters.
  • Identification of the member of the organized criminal group (OCG) named Khakim, who accompanied the explosives to the city of Moscow.
  • The circumstances and methods of departure of the members of the said OCG from the city of Moscow after the explosions, etc.
• Identification and interrogation of over seventy witnesses possessing information necessary for the investigation of the criminal case.
• Conducting 52 inspections of materials seized during the investigation and their procedural determination.
• Further conduct of investigative actions planned in the North Caucasus region to verify the completeness, reliability, and objectivity of the testimony given by the accused Magayaev and the presentation to him of the evidence obtained in the case.
• Completion of 15 forensic examinations and adjustment of the work plan for the case based on their results.

Conclusion

Considering the particular complexity of this criminal case and the need to conduct the investigative actions and search measures mentioned above, which cannot be completed within the remaining period of the investigation, as well as the fact that the measure of restraint chosen in relation to the accused Magayaev cannot be changed due to the gravity of the crime he committed and, being at large, he may hide from the investigation and the court, or obstruct the establishment of the truth in the case, guided by the requirements of Articles 97 and 133 of the Criminal Procedure Code of the RSFSR.
