ДЕККУШЕВА АДАМА ОСМАНОВИЧА, 03 февраля 1962 года рождения, уроженца КЧАО, Ставропольского края, г. Карачаевск, карачаевца, гражданина КЧАО, со средним образованием, женатого, имеющего двух несовершеннолетних детей 1989 и 1991 годов рождения, не работающего, зарегистрированного по адресу: КЧАО, Ставропольский край, г. Карачаевск, ул. Ленина, д. 75, ранее не судимого,
защитника Тарасевич Н.И., представившего удостоверение № 1924, выданного 02 августа 2000 года Московской городской коллегией адвокатов и ордер № 194 ЮК № 9, при секретаре Карабановой А.С., рассмотрев постановление старшего следователя по особо важным делам Генеральной прокуратуры Российской Федерации старшего советника юстиции Зипунникова И.И. о возбуждении ходатайства о продлении срока содержания под стражей Деккушева А.О. обвиняемого в совершении преступлений, предусмотренных ч. 3 ст. 205, ч. 3 ст. 222 УК РФ.
Проверив представленные материалы, заслушав мнение прокурора Ивановой Ю.А., обвиняемого Деккушева А.О., адвоката Тарасевич Н.И., суд

УСТАНОВИЛ:

Органами уголовного преследования Деккушев А.О. обвиняется в совершении преступлений, предусмотренных ч. 3 ст. 205 УК РФ и ч. 3 ст. 222 УК РФ, а именно: в августе - сентябре 1999 года, действуя в составе организованной преступной группы, спланировавшей совершение в г. Москве серии актов терроризма, совместно с Гочияевым А.Ш., Сайтаковым Д.Ф., Батчаевым Т.А., Крымшамхаловым Ю.И. и рядом других лиц, доставил автотранспортом с территории Северного Кавказа и разместил в нежилых помещениях города Москвы по адресам: ул. Борисовские пруды, дом №16 корп. 2 и ул. Краснодарская, дом №70 около 12 тонн изготовленных кустарным способом взрывчатых веществ со средствами взрывания. После чего, в течение 7-8 сентября этого же года, Деккушев А.О. с помощью тех же соучастников вывез с указанных складов две партии взрывчатых веществ к выбранным местам запланированных актов терроризма, в снятых для этой цели нежилых помещениях домов №19 по ул. Гурьянова и дома №6, корп. 3 по Каширскому шоссе, г. Москвы. 8 и 13 сентября 1999 г. с использованием указанных взрывных устройств Деккушев А.О., совместно с Гочияевым А.Ш., Сайтаковым Д.Ф., Батчаевым Т.А., Крымшамхаловым Ю.И. и другими участниками группы, осуществил взрывы этих двух многоквартирных домов, вместе с проживавшими в них гражданами, в результате которых погибло 223 человека, более 150 жителей получили ранения различной степени тяжести, а дома были разрушены. Указанными действиями Деккушев А.О., осуществив в составе организованной группы взрывы двух жилых домов в г. Москве, причинившие значительный имущественный ущерб и повлекшие гибель большого количества людей.
Одновременно Деккушев А.О., своими действиями в составе организованной группы, совершил незаконное приобретение, хранение и перевозку взрывчатых веществ и взрывных устройств, использованных при совершенных в г. Москве 8 и 13 сентября 1999 года, актов терроризма и приготовленных к осуществлению спланированных аналогичных преступлений.
Кроме того, по уголовному делу собраны доказательства о непосредственном участии Деккушева А.О. в осуществлении в составе указанной выше организованной преступной группы

defense attorney N.I. Tarasevich, who presented certificate No. 1924, issued on August 02, 2000 by the Moscow City Bar Association and warrant No. 194 YuK No. 9, with secretary A.S. Karabanova, having considered the resolution of the senior investigator for especially important cases of the Prosecutor General's Office of the Russian Federation, Senior Counselor of Justice I.I. Zipunnikov, on initiating a motion to extend the period of detention of A.O. Dekkushev, accused of committing crimes provided for by Part 3 of Art. 205, Part 3 of Art. 222 of the Criminal Code of the Russian Federation.

Having verified the submitted materials, having heard the opinion of prosecutor Yu.A. Ivanova, the accused A.O. Dekkushev, and defense attorney N.I. Tarasevich, the court

ESTABLISHED:

The criminal prosecution authorities accuse A.O. Dekkushev of committing crimes provided for by Part 3 of Art. 205 of the Criminal Code of the Russian Federation and Part 3 of Art. 222 of the Criminal Code of the Russian Federation, namely: in August - September 1999, acting as part of an organized criminal group that planned to commit a series of acts of terrorism in Moscow, together with A.Sh. Gochiyayev, D.F. Saitakov, T.A. Batchayev, Yu.I. Krymshamkhalov and a number of other persons, he delivered by motor transport from the territory of the North Caucasus and placed in non-residential premises in the city of Moscow at the addresses: Borisovskie Prudy St., house No. 16 bldg. 2 and Krasnodarskaya St., house No. 70 about 12 tons of homemade explosives with means of detonation. After that, during September 7-8 of the same year, A.O. Dekkushev, with the help of the same accomplices, removed two batches of explosives from the specified warehouses to the selected locations of the planned acts of terrorism, in non-residential premises rented for this purpose in houses No. 19 on Guryanova St. and house No. 6, bldg. 3 on Kashirskoye Highway, Moscow. On September 8 and 13, 1999, using the specified explosive devices, A.O. Dekkushev, together with A.Sh. Gochiyayev, D.F. Saitakov, T.A. Batchayev, Yu.I. Krymshamkhalov and other members of the group, carried out the explosions of these two apartment buildings, together with the citizens living in them, as a result of which 223 people died, more than 150 residents received injuries of varying degrees of severity, and the houses were destroyed. By these actions, A.O. Dekkushev, having carried out as part of an organized group the explosions of two residential buildings in Moscow, caused significant property damage and resulted in the death of a large number of people.

At the same time, A.O. Dekkushev, by his actions as part of an organized group, committed the illegal acquisition, storage and transportation of explosives and explosive devices used in the acts of terrorism committed in Moscow on September 8 and 13, 1999, and prepared for the implementation of planned similar crimes.

In addition, evidence has been collected in the criminal case regarding the direct participation of A.O. Dekkushev in the implementation as part of the above-mentioned organized criminal group
