ПОСТАНОВЛЕНИЕ
о возбуждении уголовного дела и принятии его к производству

Старший следователь второго отдела управления по расследованию преступлений прокуратуры Ставропольского края юрист 2 класса Калугин В.В., рассмотрев материалы об использовании сотрудником ГИБДД Кисловодского ОВД Любичевым С.С. своих служебных полномочий вопреки интересам службы из корыстных побуждений, выделенные из уголовного дела № 103, возбужденного по факту подрыва 8 и 13 сентября 1999 года жилых домов в городе Москве,

УСТАНОВИЛ:

В августе 1999 года, Любичев С.С., являясь должностным лицом — госинспектором дорожного надзора ОГИБДД Кисловодского ОВД, используя свои служебные полномочия вопреки интересам службы, действуя из корыстной заинтересованности, обеспечил беспрепятственный проезд на территорию города Кисловодска в технически неисправном состоянии автомобиля «Камаз», водитель которого не имел сопроводительных документов на перевозимый груз, в котором находилось самодельное взрывчатое вещество, замаскированное мешками с сахаром, и лично сопроводил его до складов «Реалбазы хлебопродуктов», расположенной по ул. Железнодорожной города Кисловодска, за что получил незаконное вознаграждение в виде 1 мешка сахара. Действия Любичева С.С. повлекли существенное нарушение прав и законных интересов граждан и охраняемых законом интересов общества и государства, а также тяжкие последствия. В результате осуществления актов терроризма с использованием этого взрывчатого вещества 8, 13 и 16 сентября 1999 года в городах Москве и Волгодонске погибло 244 человека, около 30 человек ранено, разрушено три

RESOLUTION

on the initiation of a criminal case and its acceptance for proceedings

Senior investigator of the second department of the crime investigation directorate of the Stavropol Krai Prosecutor's Office, 2nd class lawyer Kalugin V.V., having reviewed the materials regarding the use by GIBDD officer of the Kislovodsk OVD Lyubichev S.S. of his official powers contrary to the interests of the service for mercenary motives, separated from criminal case No. 103, initiated upon the fact of the bombing of residential buildings in the city of Moscow on September 8 and 13, 1999,

HAS ESTABLISHED:

• In August 1999, Lyubichev S.S., being an official — a state inspector of road supervision of the OGIBDD of the Kislovodsk OVD, using his official powers contrary to the interests of the service, acting out of mercenary interest, ensured the unhindered passage into the territory of the city of Kislovodsk of a technically faulty "Kamaz" vehicle, the driver of which did not have accompanying documents for the transported cargo, which contained an improvised explosive substance disguised as bags of sugar, and personally escorted it to the warehouses of "Realbaza khleboproduktov," located on Zheleznodorozhnaya St. in the city of Kislovodsk, for which he received an illegal reward in the form of 1 bag of sugar.
• The actions of Lyubichev S.S. resulted in a significant violation of the rights and legitimate interests of citizens and the interests of society and the state protected by law, as well as grave consequences.
• As a result of the implementation of acts of terrorism using this explosive substance on September 8, 13, and 16, 1999, in the cities of Moscow and Volgodonsk, 244 people died, about 30 people were wounded, three [text cuts off]
