С учетом изложенного, 25 апреля 2002 года Мыльникову А.В. предъявлено новое обвинение в совершении преступлений, предусмотренных ч.1 ст.205, ч.3 ст.30 и ч.4 ст.150 УК РФ.
В предъявленном обвинении Мыльников А.В. виновным себя не признал и заявил о своей непричастности к инкриминируемым ему преступлениям. Вместе с тем, будучи допрошенным, подтвердил факт своего знакомства с Зандер Н.В. и Тумасян А.Э. и показал, что предложение предпринять меры для освобождения Зандер Н.В. путем направления анонимного письма ультимативного характера ему поступило от Тумасян А.Э. Куда она намеревалась направить данное письмо она ему не сообщила, а непосредственных обстоятельств его изготовления он не помнит.

Противоправная деятельность обвиняемого Мыльникова А.В. в полном объеме предъявленного ему обвинения подтверждается собранными по делу доказательствами:
Показаниями свидетелей:
- Тумасян А.Э. о том, что летом 1999 г., на квартире Зандер Н.В., находившейся в тот период под стражей в связи с привлечением к уголовной ответственности, Мыльников А.В. предложил ей напечатать подготовленный им текст, содержащий требование освободить его знакомую Зандер Н.В. как безвинно страдающую мать несовершеннолетних детей, пообещав при этом, что, в случае возникновения неприятностей, «взять их на себя» и заверил в том, что ей, как несовершеннолетней, ничего не грозит, после чего передал рукописный текст «Обращения», адреса Генеральной прокуратуры РФ и редакции «Новой газеты» и проинструктировал о порядке подготовки писем: наборе и печатании текста на компьютере, принадлежащем кому-либо из ее знакомых, уничтожении файла, с которого производилась его распечатка, написании на конвертах адресов посторонними, желательно случайными, лицами. Являясь в тот период времени нештатной сотрудницей службы безопасности издательского дома «Золотые страницы» и подчиненной Мыльникова А.В., а также находясь под воздействием его рассказа о необходимости помощи несчастной женщине, Тумасян не смогла отказать в его просьбе и изготовила несколько печатных копий «Обращения» на ПЭВМ своей подруги Неудахиной М.М. по месту жительства последней. Поместив их в почтовые конверты, на которых адреса получателей были исполнены по ее просьбе неизвестными подростками, передала их Мыльникову А.В. Рукописный текст обращения она оставила у себя, а затем, вместе со своим заявлением передала, в УФСБ РФ по г. Москве и Московской области.
Касаясь обстоятельств своего личного знакомства с Зандер Н.В., Тумасян А.Э. показала, что оно произошло в январе 2000 г. после того, как последняя была освобождена из-под стражи.

• Зандер Н.В., показавшей об обстоятельствах своего знакомства с Мыльниковым А.В. в январе 1999 г., совместном проживании с ним вплоть до ее ареста 8 июля того же года, предпринимавшихся им затем мерах по ее освобождению, в частности обращениях в средства массовой информации, с целью если не добиться изменения ей меры пресечения, то поднять ей авторитет в местах лишения свободы в случае осуждения.

Case Summary

In view of the above, on April 25, 2002, A.V. Mylnikov was presented with a new charge of committing crimes provided for by Part 1 of Art. 205, Part 3 of Art. 30, and Part 4 of Art. 150 of the Criminal Code of the Russian Federation.

Regarding the charges presented, A.V. Mylnikov did not plead guilty and declared his non-involvement in the crimes incriminated against him. At the same time, being interrogated, he confirmed the fact of his acquaintance with N.V. Zander and A.E. Tumasyan and testified that the proposal to take measures for the release of N.V. Zander by sending an anonymous letter of an ultimatum nature came to him from A.E. Tumasyan. She did not inform him where she intended to send this letter, and he does not remember the direct circumstances of its production.

Evidence of Unlawful Activity

The unlawful activity of the accused A.V. Mylnikov in the full scope of the charges brought against him is confirmed by the evidence collected in the case:

Witness testimonies:

• A.E. Tumasyan: Stated that in the summer of 1999, at the apartment of N.V. Zander, who was in custody at that time in connection with criminal prosecution, A.V. Mylnikov suggested she type a text he had prepared, containing a demand to release his acquaintance N.V. Zander as an innocently suffering mother of minor children, promising at the same time that, in case of trouble, he would "take it upon himself" and assured her that as a minor, she was not in any danger. After which he handed over the handwritten text of the "Appeal", the addresses of the General Prosecutor's Office of the RF and the editorial office of "Novaya Gazeta" and instructed her on the procedure for preparing the letters: typing and printing the text on a computer belonging to one of her acquaintances, deleting the file from which the printout was made, and having the addresses on the envelopes written by outsiders, preferably random persons. Being at that time a freelance employee of the security service of the "Golden Pages" publishing house and a subordinate of A.V. Mylnikov, and also being under the influence of his story about the need to help an unfortunate woman, Tumasyan could not refuse his request and produced several printed copies of the "Appeal" on the PC of her friend M.M. Neudakhina at the latter's place of residence. Having placed them in mailing envelopes, on which the recipient addresses were written at her request by unknown teenagers, she handed them over to A.V. Mylnikov. She kept the handwritten text of the appeal for herself, and then, together with her statement, handed it over to the UFSB RF for Moscow and the Moscow Region.
  • Regarding the circumstances of her personal acquaintance with N.V. Zander, A.E. Tumasyan testified that it occurred in January 2000 after the latter was released from custody.

• N.V. Zander: Testified about the circumstances of her acquaintance with A.V. Mylnikov in January 1999, living together with him until her arrest on July 8 of the same year, and the measures he subsequently took for her release, in particular appeals to the mass media, with the aim of, if not achieving a change in her preventive measure, then raising her authority in places of deprivation of liberty in case of conviction.
