- On July 14, 2002, Adam Osmanovich Dekkushev was charged with

subject to proof in accordance with Art. 73 of the Code of Criminal Procedure of the Russian Federation, as well as the point, part, article of the Criminal Code of the Russian Federation,
and explosive devices, that is, with committing crimes provided for by Part 3
providing for liability for this crime)
of Art. 205 and Part 3 of Art. 222 of the Criminal Code of the Russian Federation, in connection with the bombings of residential buildings in Moscow on September 8 and 13,- Currently, sufficient evidence has been collected in the criminal case
to provide grounds for amending and supplementing the charges previously brought against
A.O. Dekkushev and bringing a new charge against him in the following wording:
At the beginning of 1997, A.O. Dekkushev, who resided permanently in the Karachay-
Cherkess Republic, arrived in the territory of the Chechen Republic, where on his own
initiative he joined an illegal armed formation (IAF) created in violation of the Federal Law of the Russian
Federation No. 61-FZ dated May 31, 1996 "On Defense" by citizens of foreign states
Emir Al-Khattab, Abu Al-Walid, Abu Umar, and Abu Jafar and
led by them, the Islamic Institute "Caucasus," which had a military organization, and was armed with its members -
various types of firearms and other weapons and military equipment. In the training camps
of this IAF, located near the village of Serzhen-Yurt in the Chechen Republic, Dek-
kushev A.O., during 1997, under the guidance of instructors who were citizens of foreign

- States, both leaders and rank-and-file members of the IAF (Illegal Armed Formation), underwent training in the use of small arms and the conduct of combat operations. He engaged in physical training.
- In the period from September 1999 to February 2001, A.O. Dekkushev, being part of the aforementioned IAF and armed with a firearm—an AK-74 Kalashnikov assault rifle of 5.45 mm caliber with ammunition—took part in combat operations against units of the Armed Forces and law enforcement agencies of the Russian Federation conducting a counter-terrorist operation on the territory of the Chechen Republic, in the area of the Chervlyonnaya station, the villages of Serzhen-Yurt and Shatoy, in the Nadterechny district, while carrying out transportation of IAF participants, delivery of ammunition, food, and various equipment to them in a "Ural" truck assigned to him.
Legal Conclusion
- By the actions indicated above, A.O. Dekkushev committed participation in an armed formation not provided for by federal law, that is, a crime provided for by Part 2 of Article 208 of the Criminal Code of the Russian Federation.
Formation of Organized Group
- In July 1999, the leaders of the IAF Islamic Institute "Caucasus," Emir Al-Khattab and Abu Umar, on the territory of the North Caucasian subjects of the Russian Federation, created an organized group, which included members of the aforementioned IAF:

- Several persons not identified by the investigation.
- The plans of this organized group included the commission of a series of acts of terrorism on the territory of the Russian Federation:
- Carrying out explosions in populated areas, aimed at the mass death of people and, thereby, the violation of public safety, intimidation of the population, and exerting influence on the decision-making by authorities regarding the liquidation of the consequences of the attack on the Republic of Dagestan planned by that time by the leaders of illegal armed formations based on the territory of the Chechen Republic in August 1999, that is, preventing the authorities from taking measures to displace these IAFs from Dagestan and destroy them.
- According to the distribution of duties among the participants of the organized criminal group, Emir Al-Khattab and Abu Umar were assigned an organizing and leading role, as well as financial support for the planned crimes.

Terrorist Plot Details
Unidentified persons were to acquire and manufacture an improvised explosive substance, other necessary components for the manufacture of explosive devices, as well as organize their delivery to the planned locations for the commission of acts of terrorism in the cities of Moscow and Volgodonsk, Rostov Region. After that, using the said explosive substance and other components of explosive devices, Gochiyayev A.Sh., Batchaev Z.A., Saitakov D.F., Abaev Kh.M. and unidentified persons were to carry out terrorist acts in the city of Moscow, and Dekkushev A.O., Krymshamkhalov Yu.I. and Batchaev T.A. – in the city of Volgodonsk.
Acquisition of Materials
Implementing the plans of the organized criminal group, Dekkushev A.O. in July - early August 1999, both independently and together with Krymshamkhalov Yu.I., Gochiyayev A.Sh., Batchaev T.A., Batchaev Z.A., Saitakov D.F., Abaev Kh.M., Tsokiev M.D. and unidentified persons, acquired:
- Over 1 ton of aluminum powder, about 7 tons of granulated sugar and about 2 tons of potatoes, acquired in the city of Volgograd and on the territory of the North Caucasus region, intended for masking the manufactured explosive substance during its transportation.
- 280 bags for packaging the manufactured explosive substance.
- Over 13 electric detonators (ED-8Zh, EDKZ and ED-3-ZN).
- More than 2.5 meters (over 11.5 kg) of detonating cable of the DKRP-4 charge for UZP-72 (UZP-77) mine-clearing installations.
- More than 30 meters of DShE-12 detonating cord.
- Over 6 electric delayed-action fuses with electronic timers, illegally manufactured.
- A large number of "Energizer" electric batteries.
For the same purposes, Abaev Kh.M. and an unidentified person known to the investigation as "Saleh", in July-early August 1999 on the territory of the North Caucasus region illegally acquired about 13 tons of improvised mixed explosive substance, manufactured under circumstances not clarified by the investigation and consisting of ammonium nitrate, TNT and sugar.
In addition, at the same time Dekkushev A.O. and Krymshamkhalov Yu.I. rented a premises for performing work on the manufacture and packaging of the explosive substance, a concrete mixer for mixing components during the manufacture of the explosive substance and a machine for sewing bags with the explosive substance.
Further Actions
In the first half of August 1999, Dekkushev A.O., Krymshamkhalov Yu.I., Batchaev T.A., Batchaev Z.A., Saitakov D.F., Abaev Kh.M., Tsokiev M.D. and unidentified persons, implementing the plan of the organized group, in a specially rented premises of outbuildings of house No. 28 on Vysokogornaya St. in the settlement of Mir-
Illegal Manufacturing and Transportation of Explosives
- A resident of the Predgorny district of the Stavropol Krai illegally manufactured over 14 tons of a homemade explosive mixture.
- The mixture consisted of aluminum powder, ammonium nitrate, TNT, and sugar, created by mixing aluminum powder and a mixture acquired by Abaev Kh.M. and "Salekh".
- The members of the criminal group packaged the manufactured explosive substance into 280 bags specifically purchased for this purpose.
Transportation to Kislovodsk
- In mid-August 1999, Dekkushev A.O. and the participants of the organized criminal group illegally transported these bags from the settlement of Mirny to the city of Kislovodsk, Stavropol Krai.
- The transport was made using a "KAMAZ-53212" vehicle (state registration plate A 831 AM 09), driven by Magayaev R.Sh., who was unaware of the criminal activities.
- The bags were subsequently stored illegally in the bed of the vehicle on the territory of ZAO "Realbaza khleboproduktov" at 20 Zheleznodorozhnaya St.
Transportation to Moscow and Volgodonsk
- In early September 1999, Dekkushev A.O., together with Krymshamkhalov Yu.I., Gochiyaev A.Sh., Batchaev T.A., Batchaev Z.A., Saitakov D.F., Abaev Kh.M., Tsokiev M.D., and unidentified persons, organized and carried out the illegal transportation of the manufactured explosive substance and its detonation means.
- The means for detonation included:
- Electric detonators
- Detonating cable for mine-clearing installations
- Delayed-action electric fuses with electronic timers
- Detonating cord
- "Energizer" electric batteries
- Transport to Moscow:
- The substance and means were transported from the territory of the Stavropol Krai to the city of Moscow on a "Mercedes-Benz 2236" vehicle (state registration plate 10-59 SSM).
- The drivers, Tishin N.N. and Spasibukhov V.A., were unaware of the criminal activities.
- The amount transported was over 10 tons, disguised and documented as sugar.
- Transport to Volgodonsk:
- The substance and means were transported on a "KAMAZ-5320" vehicle (state registration plate A 048 VU 09).
- The drivers were members of the organized group, Krymshamkhalov Yu.I. and Batchaev T.A.
- The amount transported was over 4 tons, disguised and documented as potatoes.
Implementation of the Plan
- To implement the plan of the organized criminal group, Gochiyaev A.Sh., using a forged USSR citizen passport in the name of a resident of the Karachay-Cherkess Republic, Laipanov M.N., registered in the city of Moscow on August 30, 1999, proceeded to...
Storage and Transport of Explosives
The company LLC "BRAND-2," whose general director was mentioned, rented storage facilities in Moscow in early September 1999 at the following locations:
- Building No. 70 on Krasnodarskaya St. (Proyektiruemyy Proyezd, building 5381)
- Building No. 19 on Guryanova St.
- Building No. 16, building 2 on Borisovskiye Prudy St.
- Building No. 6, building 3 on Kashirskoye Highway
Storage and Transport on September 7, 1999
- On September 7, 1999, Gochiyayev A.Sh., Batchayev Z.A., Saitakov D.F., Abayev Kh.M., and unidentified persons stored explosive substances and detonation means in a specially rented storage facility at Krasnodarskaya St., building No. 70 (Proyektiruemyy Proyezd, building 5381).
- The stored items included:
- Over 10 tons of explosive substance delivered to Moscow.
- Electric detonators.
- Detonating cable for mine clearance units.
- Electric delayed-action fuses with electronic timers.
- Detonating cord.
- "Energizer" batteries.
- The stored items included:
- On the same day, September 7, 1999, Gochiyayev A.Sh. and other members of the organized group illegally transported over 2 tons of explosive substance and its detonation means from the warehouse at building No. 70 on Krasnodarskaya St. to a non-residential basement premises of building No. 6, building 3 on Kashirskoye Highway, which was specially rented for this purpose.
- The transport was made in a "ZIL-5301" vehicle (state registration plate R 520 SK 50), driven by Sinitsyn V.P., who was unaware of the criminal activities.
- They illegally stored the materials in the basement.
- Concurrently, Gochiyayev A.Sh. and members of the organized criminal group illegally manufactured an explosive device from the transported materials, using a homemade electric delayed-action fuse with an electronic timer, and placed it in the aforementioned non-residential basement premises.
Transport on September 8, 1999
- On September 8, 1999, Gochiyayev A.Sh., Batchayev Z.A., Saitakov D.F., Abayev Kh.M., and unidentified persons illegally transported over 1.9 tons of explosive substance and its detonation means from the specified warehouse in building No. 70 on Krasnodarskaya St.
- The transport was made in a "ZIL-5301" vehicle (state registration plate M 577 XA 77), driven by Prushinsky A.B., who was unaware of the criminal activities.
- The transported items included:
- Electric detonators.
- Detonating cable for mine clearance units.
- Electric delayed-action fuses...
Incident Details
- Storage at House No. 16, Building 2, Borisovskie Prudy St.:
- They illegally stored:
- Action with electronic timers, detonating cord, and 'Energizer' batteries.
- Over 2 tons of explosive material and means of its detonation (electric detonators, detonating cable for mine-clearing installations, electric delayed-action fuses with electronic timers, detonating cord, and 'Energizer' batteries).
- This storage was in a non-residential premises specially rented for this purpose on the 1st floor.
- They illegally stored:
- Storage at House No. 19, Guryanova St.:
- They illegally stored the materials mentioned above in a non-residential premises specially rented for this purpose on the 1st floor.
- At this location, Gochiyaev A.Sh. and members of the organized criminal group illegally manufactured an explosive device from the transported explosive material and means of its detonation, using a homemade electric delayed-action fuse with an electronic timer, placing it in the same location (the non-residential premises on the 1st floor).
Transport and Manufacturing in Volgodonsk
- Delivery to Volgodonsk:
- Over 4 tons of explosive material and means of its detonation (electric detonators, detonating cable for mine-clearing installations, electric delayed-action fuses with electronic timers, detonating cord, and 'Energizer' batteries) were delivered to the city of Volgodonsk by Dekkushev A.O., Krymshamkhalov Yu.I., and Batchaev T.A., as part of the organized criminal group's plan, on September 13-14, 1999.
- The materials were reloaded into a 'GAZ-53' vehicle (state registration plate Ts 37-81 RP), which they had specially purchased for this purpose.
- They illegally stored these materials for some time on the territory of motorcade No. 2070, located in the city of Volgodonsk at the 7th kilometer of the 'Volgodonsk-Tsimlyansk' highway.
- At this location, Batchaev T.A., together with Dekkushev A.O. and Krymshamkhalov Yu.I., illegally manufactured an explosive device from these materials and means of its detonation, using a homemade electric delayed-action fuse with an electronic timer, placing it in the van of the vehicle.
- Final Placement:
- On September 15, 1999, Dekkushev A.O., continuing the criminal intent of the organized group and misleading the former owner of the 'GAZ-53' vehicle, Iskenderov A.I., parked this vehicle with the explosive device in its van and set to combat readiness near entrance No. 4 of house No. 35 on Oktyabrskoe Highway in the city of Volgodonsk.
Terrorist Acts in Russia
In September 1999, A.O. Dekkushev, implementing the plans of an organized group to carry out a series of large-scale acts of terrorism in the Russian Federation for the purpose of intimidating the population and influencing decision-making by government bodies, and acting together with Yu.I. Krymshamkhalov, T.A. Batchaev, A.Sh. Gochiyayev, Z.A. Batchaev, D.F. Saitakov, Kh.M. Abaev, M.D. Tsokiev and unidentified persons, personally and with the direct execution of the above-named participants of the organized group, committed, using explosives and means of detonation manufactured and delivered by them to the cities of Moscow and Volgodonsk, explosions of two residential apartment buildings with people inside in the city of Moscow and the detonation of a high-power explosive device near a residential apartment building with people inside in the city of Volgodonsk.
Moscow Explosion (September 8, 1999)
On September 8, 1999, at approximately 24:00, A.Sh. Gochiyayev, Z.A. Batchaev, D.F. Saitakov, Kh.M. Abaev and unidentified persons, using a high-power improvised explosive device with an electric delay detonator and an electronic timer, located in non-residential premises on the 1st floor of building No. 19 on Guryanova St. in Moscow rented by A.Sh. Gochiyayev, committed an explosion of this 9-story 6-entrance residential building.
The consequences included:
* 100 people died.
* 690 people received injuries of varying degrees of severity or suffered in one way or another, having received moral trauma.
* Significant material damage in the amount of at least 360,221,700 (three hundred sixty million two hundred twenty-one thousand seven hundred) rubles was caused to the state and citizens in connection with the destruction of residential buildings No. 19 and No. 17 on Guryanova St. and damage to residential buildings adjacent to the epicenter of the explosion.
Volgodonsk Explosion (September 13, 1999)
On September 13, 1999, at approximately 5:00 AM, A.Sh. Gochiyayev, Z.A. Batchaev, D.F. Saitakov, Kh.M. Abaev and unidentified persons, using a high-power improvised explosive device with an electric delay detonator and an electronic timer, located in a rented non-residential basement of building No. 6 building 3 on Kashirskoye Highway in Moscow, committed an explosion of this 8-story residential building.
The consequences included:
* 124 people died.
* 7 people received injuries of varying degrees of severity.
* Significant material damage was caused to the state and citizens in connection with the destruction of this building and damage to residential buildings adjacent to the epicenter of the explosion.
Damage Assessment
...damage in the amount of no less than 131,036,671 (one hundred thirty-one million thirty-six thousand six hundred seventy-one) rubles.
Incident Details
On September 16, 1999, at approximately 6:00 AM, A.O. Dekkushev, Yu.I. Krymshamkhalov, and T.A. Batchaev detonated a high-power improvised explosive device with a delayed-action electric detonator and an electronic timer. The device was located in the van of a "GAZ-53" vehicle they had purchased, parked at entrance No. 4 of building No. 35 on Oktyabrskoye Highway in the city of Volgodonsk.
The explosion resulted in:
* 19 people died.
* 1,045 people received injuries of varying degrees of severity or suffered to one degree or another, having received moral trauma.
* Significant material damage to the state and citizens due to the destruction and damage of residential buildings adjacent to the epicenter of the explosion, amounting to no less than 337,604,000 (three hundred thirty-seven million six hundred four thousand) rubles.
Criminal Charges
By the actions indicated above, A.O. Dekkushev, as part of an organized group, repeatedly committed terrorism—explosions creating a danger of loss of life, causing significant property damage, and the occurrence of other socially dangerous consequences, for the purpose of violating public safety, intimidating the population, and exerting influence on decision-making by government bodies. This constitutes a crime provided for by Part 3 of Article 205 of the Criminal Code of the Russian Federation.
Illegal Activities
In addition, in October 1999, to participate in combat operations against units of the Armed Forces and law enforcement agencies of the Russian Federation on the territory of the Chechen Republic, A.O. Dekkushev:
- Illegally received a firearm—a Kalashnikov AK-74 assault rifle, 5.45 mm caliber, and over 180 rounds of ammunition for it—from an unidentified person at the IAF [Illegal Armed Formation] base Islamic Institute "Caucasus" near the village of Serzhen-Yurt.
- Illegally stored and carried these items between October 1999 and February 2001.
- As a member of an illegal armed formation operating on the territory of the Chechen Republic, he illegally transported ammunition, explosives, and various weapons on the instructions of IAF leaders using a "Ural" truck to militant positions near the villages of Chervlyonnaya, Serzhen-Yurt, and Shatoy, and in the Nadterechny district.
By his actions related to the acquisition, under the circumstances set forth above during the preparation and commission of terrorist acts, during the period of participation in the IAF, of explosives and means for their detonation, an assault rifle and cartridges for it, their storage-
Criminal Activities of Dekkushev A.O.
- Dekkushev A.O., as part of an organized group, repeatedly committed the illegal acquisition, storage, transportation, and carrying of firearms, ammunition, explosives, and explosive devices, which is a crime provided for by Part 3 of Article 222 of the Criminal Code of the Russian Federation.
- Simultaneously, by his actions, expressed in the manufacture under the circumstances set forth above during the preparation of terrorist acts of over 14 tons of explosive material and explosive devices for its detonation, Dekkushev A.O., as part of an organized group, repeatedly committed the illegal manufacture of explosives and explosive devices, which is a crime provided for by Part 3 of Article 223 of the Criminal Code of the Russian Federation.
- In September 1999, Dekkushev A.O., implementing the plans of an organized group to carry out large-scale acts of terrorism in the Russian Federation for the purpose of intimidating the population and influencing decision-making by government bodies, and acting jointly with Gochiyayev A.Sh., Krymshamkhalov Yu.I., Batchayev T.A., Batchayev Z.A., Saitakov D.F., Abayev Kh.M., Tsokiyev M.D., and unidentified persons, personally and with the direct execution of the above-named participants of the organized group, used the explosive material and means of its detonation manufactured and delivered by them to the cities of Moscow and Volgodonsk, committing attempts on the lives of people who were in the residential buildings they blew up and on the adjacent territory.
September 8, 1999 Incident
- On September 8, 1999, at approximately 24:00, implementing the intent of the above-named organized criminal group aimed at killing the maximum number of people in the nearby multi-story residential buildings No. 19 and No. 17 on Guryanova St. in Moscow and on the adjacent territory, Gochiyayev A.Sh., Batchayev Z.A., Saitakov D.F., Abayev Kh.M., and unidentified persons, as part of an organized group, carried out the detonation of the aforementioned high-power improvised explosive device located in a non-residential premise on the 1st floor of building No. 19 on Guryanova St., using a delayed-action electric detonator with an electronic timer.
Consequences of the Explosion
- As a result of the explosion, fragments of broken glass, the resulting fire and smoke, the shock and sound waves of the explosion, and secondary projectiles—items of apartment furnishings—impacted the victims [who were located]...
Casualties
- Konyukhova Olga Semyonovna, born 1971, died from bodily injuries incompatible with life:
- Open craniocerebral injury with destruction and prolapse of the brain.
- Fractures of the bones of the vault and base of the skull.
- Facial skeleton injury.
- Injury to the cervical spine with a double fracture of the spinal column.
- Complete rupture of the spinal cord.
- Rupture of the aorta.
- Extensive trauma to the torso and limbs with fractures of all bones of the skeleton.
- Crushing of vital organs: liver, spleen, lungs, and heart.
- Kirik Viktoria Leonidovna, born 1971, died from an open penetrating craniocerebral injury with fractures of the skull bones, contusions, and partial crushing of the brain matter.
Survivors
Due to circumstances beyond the control of the criminals, among the citizens who were at the moment of the explosion in residential building No. 6, building 3 on Kashirskoye Shosse, in multi-story residential buildings nearby its epicenter and on the adjacent territory of the city, those who survived having received serious harm to their health were:
- Safontsev Yuri Arkadyevich, born 1952 - severe combined body trauma.
- Misharin Maksim Feliksovich, born 1975 - severe combined body trauma.
Those who received light harm to their health were:
- Antonova Lyudmila Vladimirovna, born 1952 - a concussion.
- Kirushkina Ekaterina Aleksandrovna, born 1989 - a concussion, abrasions in the area of the face and shins.
- Kirushkina Svetlana Aleksandrovna, born 1992 - a closed craniocerebral injury.
- Kushniryuk Aleksandr Georgievich, born 1968 - a contused wound of the frontal region.
- Marchenko Ekaterina Pavlovna, born 1937 - partial damage to the ligamentous apparatus of the left ankle joint.
Those who received bodily injuries that did not cause harm to health:
- Stepkina Anastasia Borisovna, born 1984 - an abrasion of the right parietal region.
The intent of Dekkushev A.O. and other members of the organized criminal group to murder them was not carried out by them to completion.
Incident Details
On September 16, 1999, at approximately 6 o'clock in the morning, implementing the intent of the aforementioned organized group aimed at killing the maximum number of people who were at that moment in nearby multi-story residential buildings Nos. 31, 35, 35 "a", 37 on Oktyabrskoye Shosse, Nos. 54, 58, 60 on Gagarin St. and in other nearby houses and on the adjacent territory in the city of Volgodonsk, Rostov region, Dekkushev A.O., Krymshamkhalov Yu.I., and Batchaev T.A., as part of an organized group using a delayed-action electric detonator...
Incident Report Summary
- An improvised explosive device was detonated using an electronic timer.

Casualties
The explosion resulted in the deaths of several elderly citizens and minors in building No. 35 on Oktyabrskoye Shosse, due to various factors including:
- Fragments of broken glass from destroyed building structures.
- Fire and smoke.
- Shock and sound waves of the blast.
- Secondary projectiles (furniture from the apartments).
- Other traumatic factors associated with the explosion.
The deceased individuals are:
- Fetisova Marina Anatolyevna (born 1975): Died from explosive trauma accompanied by closed blunt trauma to the chest and abdomen, resulting in multiple ruptures of the liver and spleen, hemorrhages into the lung tissue and the suspensory apparatus of internal organs, multiple abrasions and contused wounds on the head, torso, and limbs, leading to massive blood loss and traumatic shock.
- Mordovtsev Sergey Nikolaevich (born 1976): Died as a result of explosive trauma from massive blood loss due to a lacerated wound of the neck with damage to the right carotid artery.
- Skrylev Stanislav Nikolaevich (born 1969): Died as a result of explosive trauma accompanied by the destruction of skull bones and damage to brain tissue, injuries to the right hand, complicated by edema of the brain and lungs.
