уголовного дела № 9271, собрала значительный объем материалов (...), включающий многолетний незаконный оборот взрывчатых материалов, хищения, злоупотребления полномочиями, мошенничество, неуплату налогов. Однако по непонятным причинам в октябре сего года практически все члены этой следственной группы были заменены на новых сотрудников (...)».
Отметим, что следственную группу разогнали вскоре после того, как министр предоставил все имеющиеся у него материалы о «Росконверсвзрывцентре».

8 ноября 2000 года глава Минобразования обратился к заместителям председателя Правительства РФ Матвиенко и Клебанову и в Комитет Госдумы РФ по безопасности о том, что МВД РФ не предприняло надлежащих мер по расследованию уголовного дела.

4 декабря 2000 года Филиппов просил директора ФСБ Патрушева приложить усилия к тому, чтобы уголовное дело № 9271 было передано для расследования в Следственное управление ФСБ РФ. С той же просьбой министр обратился к генеральному прокурору Устинову. В своем обращении (№ 01-52-239 ин) министр обратился, в частности, просил изъять материалы из Следственного комитета при МВД РФ и передать их в делопроизводство Генеральной прокуратуры, с возможным привлечением к данной работе сотрудников ФСБ. А также «дать указания соответствующим должностным лицам изучить материалы, вскрытые во время работы комиссии Минобразования России». Об этом вопросе был проинформирован также секретаря Совета безопасности РФ Сергей Иванов.
Реакция на все эти обращения была парадоксальной. Следственный комитет при МВД РФ, который просили ознакомить министра с копией постановления о возбуждении уголовного дела, ответил официальным отказом, хотя никакой тайны этот документ* не представляет (возможно, сноской:
*«24.08.2000 г. старший следователь по особо важным делам Следственной части СК при МВД РФ полковник юстиции Важдалов С. К., рассмотрев материалы по факту незаконного сбыта взрывчатых веществ, поступивших из ГУБОП МВД России, установил: в период с 07.03.2000 г. по 16.06.2000 г. руководители НИИ «Росконверсвзрывцентр» Министерства Образования РФ, являющегося государственным предприятием, не имея соответствующего разрешения и в нарушение установленных законом правил, осуществили поставку и незаконно сбыли 397758 шт. баллиститных шашек и гранипора ПФЗ (пороха зерненного флегматизированного), являющихся взрывчатым веществом, ГП «Гранит» и открытому АО «Доломит», расположенным на территории Республики Беларусь.
Аналогичным образом 25.07.2000 г. руководители НИИ «Росконверсвзрывцентр» осуществили поставку и незаконно сбыли Учалинскому горно-обогатительному комбинату (...), 16 тонн баллиститных шашек, являющихся взрывчатым веществом.
Принимая во внимание, что в материалах содержатся достаточные данные, указывающие на наличие в действиях руководителей НИИ «Росконверсвзрывцентр» признаков преступления, предусмотренного частью 2 ст. 222 УК РФ, руководствуясь частью 6 ст. 108, частью 3 ст. 109, частью 2 ст. 112, частью 2 ст. 129 УПК РСФСР, постановил: 1) возбудить по фактам незаконного сбыта взрывчатых веществ руководителями НИИ «Росконверсвзрывцентр» уголовное дело № 9271 по признакам преступления, предусмотренного частью 2 ст. 222 УК РФ. 2) Уголовное дело принять к своему производству и приступить к проведению предварительного следствия. 3) Копию настоящего постановления направить в генеральную прокуратуру РФ.

The investigation into "Roskonversvzryvtsentr" involved a significant volume of materials related to:

Response from the Investigative Committee

The reaction to these appeals was paradoxical. The Investigative Committee under the MVD of the Russian Federation officially refused the minister's request to review a copy of the decision to initiate a criminal case, despite the document containing no secrets.

Details of the Criminal Case Initiation (August 24, 2000)

On August 24, 2000, Colonel of Justice S. K. Vazhdalov, Senior Investigator for Particularly Important Cases of the Investigative Unit of the Investigative Committee under the MVD of the Russian Federation, established the following after reviewing materials regarding the illegal sale of explosives received from the GUBOP of the MVD of Russia:

Illegal Sales by Heads of the Research Institute 'Roskonversvzryvtsentr' (State Enterprise):

• Period: March 7, 2000, to June 16, 2000
• Action: The heads of the Institute supplied and illegally sold 397,758 units of ballistic blocks and Granipor PFZ (phlegmatized granular powder)—both explosives—to:
  • The State Enterprise 'Granit'
  • The Open JSC 'Dolomit' (located on the territory of the Republic of Belarus)
• Second Sale: On July 25, 2000, the heads of the Institute supplied and illegally sold 16 tons of ballistic blocks (explosives) to the Uchalinsky Mining and Processing Plant.

Decision Made by S. K. Vazhdalov:

Taking into account that the materials contained sufficient data indicating signs of a crime under Part 2 of Art. 222 of the Criminal Code of the Russian Federation, guided by specific articles of the Code of Criminal Procedure of the RSFSR, the following decisions were made:

1. To initiate criminal case No. 9271 regarding the illegal sale of explosives by the heads of the Research Institute 'Roskonversvzryvtsentr'.
2. To take the criminal case into its own proceedings and proceed with the preliminary investigation.
3. To send a copy of this decision to the Prosecutor General's Office of the Russian Federation.
