• This was carried out by members of illegal armed formations Krymshamkhalov Yu.I. and Dekkushev A.O. from the village of Mirny, Predgorny District, to the city of Kislovodsk.
• Lyubichev S.S., while in a "Moskvich-Svyatogor" car driven by Dekkushev A.O., prevented the vehicle from being stopped by police officers while escorting it from DPS Post No. 1 of the Kislovodsk OVD GIBDD department to the warehouses of AOZT "Realbaza khleboproduktov," located at Kislovodsk, Zheleznodorozhnaya St., 20.
• By these actions, Lyubichev S.S. obstructed the timely detection of a crime provided for by Part 3 of Art. 222 of the Criminal Code of the Russian Federation, resulting in a significant violation of the state's interests.

Criminal Charges Against Lyubichev S.S.

• Article 285, Part 1 of the Criminal Code of the Russian Federation: Lyubichev S.S. committed this crime through intentional actions, based on the use of his official powers contrary to the interests of the service, when this act is committed for other personal interest and results in a significant violation of the state's interests protected by law.
• Article 290, Part 2 of the Criminal Code of the Russian Federation: Lyubichev S.S. committed this crime through intentional actions, with the qualifying attribute of receiving a bribe for illegal actions.

Specific Incident Details

• In mid-August 1999, between 10:00 and 14:00, Lyubichev S.S., acting as a state inspector of road supervision of the GIBDD department of the Kislovodsk OVD, engaged in illegal actions favoring Krymshamkhalov Yu.I.
• His official duties included the prevention and suppression of crimes and administrative offenses, as well as the detection and disclosure of crimes, according to paragraphs 1 and 4 of Art. 10 of the Law of the Russian Federation "On the Police."
• While in uniform, Lyubichev S.S. ensured the unhindered passage through DPS Post No. 1 of the Kislovodsk OVD GIBDD department into the territory of the city of Kislovodsk, Stavropol Krai, of a "Kamaz-53212" vehicle (state registration plate A 831 AM 09).
• This vehicle was in a technically faulty condition (missing part of the windshield) and was driven by Magayaev R.Sh., who lacked a driver's license or documents for the transported cargo, violating requirements 2.1.1 and 2.3.1 of the Traffic Rules of the Russian Federation.
• For these illegal actions in the area of AOZT "Realbaza khleboproduktov" (Kislovodsk, Zheleznodorozhnaya St., 20), Lyubichev S.S. personally received a bribe from Krymshamkhalov Yu.I. in the form of property: one bag of granulated sugar weighing 50 kg, valued at 420 rubles.
