мешках общей массой 1900 кг, свыше 10 электродетонаторов, брикеты с пластичным ВВ массой 11кг, 30 метров детонирующего шнура, часовые взрыватели с временем срабатывания 00 час. 25 мин.
Взрывчатые вещества, незаконно хранившиеся и приготовленные для совершения не менее двух актов терроризма, не были взорваны по независящим от виновных обстоятельствам. Сотрудниками правоохранительных органов взрывчатые вещества в указанных местах были обнаружены и изъяты 13 сентября 1999 года. По факту незаконного хранения взрывчатых веществ по адресу г. Москва, ул. Краснодарская, строение № 70 процессуальное решение в порядке ст. 109 УПК РСФСР необоснованно не принималось.
Таким образом, из названных выше фактов усматриваются достаточные данные, указывающие на признаки самостоятельных преступлений.
С учётом изложенного, руководствуясь статьями 26, 108, 109, 112, 211 пунктами 2, 3, 11 УПК РСФСР,

Постановил:

1. Постановление, вынесенное ст. следователем СО при ОВД района «Братеево» ЮАО майором юстиции Сусановым А.И. с согласия Нагатинского межрайпрокурора г. Москвы по уголовному делу, имевшему первоначальный № 75908 от 15 сентября 1999 года, в части переквалификации по ч. 2 ст. 205 УК РФ - за необоснованностью и незаконностью - отменить.
2. Возбудить уголовное дело по факту приготовления к совершению акта терроризма в корпусе № 2 дома № 16 ул. Борисовские пруды, Южного административного округа г. Москва по признакам преступления, предусмотренного п. 2 ст. 30, ч. 3 ст. 205 УК РФ.
3. Возбудить уголовное дело по фактам незаконного хранения взрывчатых веществ и взрывных устройств организованной группой и приготовления к совершению акта терроризма в строении № 70 ул. Краснодарская, Юго - Восточного административного округа г. Москва по признакам преступлений, предусмотренных ч. 3 ст. 222, п. 2 ст. 30, ч. 3 ст. 205 УК РФ.
4. Возбужденные уголовные дела, указанные в пунктах 2,3 постановления, соединить с уголовным делом № 103.
5. Копию постановления направить прокурорам Нагатинской межрайонной прокуратуры и Люблинской межрайонной прокуратуры города Москвы.

Explosives and Terrorism Investigation

• Bags with a total mass of 1900 kg.
• Over 10 electric detonators.
• Briquettes with plastic explosives weighing 11 kg.
• 30 meters of detonating cord.
• Clockwork fuses with a trigger time of 00 hours 25 min.

The explosives, illegally stored and prepared for the commission of at least two acts of terrorism, were not detonated due to circumstances beyond the control of the perpetrators. Law enforcement officers discovered and seized the explosives at the indicated locations on September 13, 1999. Regarding the fact of illegal storage of explosives at the address: Moscow, Krasnodarskaya St., building No. 70, a procedural decision in accordance with Art. 109 of the RSFSR Code of Criminal Procedure was unreasonably not taken.

Thus, from the facts mentioned above, sufficient data are seen indicating signs of independent crimes.

In view of the above, guided by articles 26, 108, 109, 112, 211 paragraphs 2, 3, 11 of the RSFSR Code of Criminal Procedure,

Ordered:

1. To cancel the resolution issued by the Senior Investigator of the Investigative Department at the Internal Affairs Directorate of the "Brateevo" district of the Southern Administrative District, Major of Justice A.I. Susanov, with the consent of the Nagatinsky Inter-District Prosecutor of Moscow, in the criminal case originally numbered 75908 dated September 15, 1999, in the part concerning reclassification under Part 2 of Art. 205 of the Criminal Code of the Russian Federation—due to lack of grounds and illegality.
2. To initiate a criminal case on the fact of preparation for the commission of an act of terrorism in building No. 2 of house No. 16 on Borisovskie Prudy St., Southern Administrative District of Moscow, based on the signs of a crime provided for by paragraph 2 of Art. 30, Part 3 of Art. 205 of the Criminal Code of the Russian Federation.
3. To initiate a criminal case on the facts of illegal storage of explosives and explosive devices by an organized group and preparation for the commission of an act of terrorism in building No. 70 on Krasnodarskaya St., South-Eastern Administrative District of Moscow, based on the signs of crimes provided for by Part 3 of Art. 222, paragraph 2 of Art. 30, Part 3 of Art. 205 of the Criminal Code of the Russian Federation.
4. To merge the initiated criminal cases specified in paragraphs 2 and 3 of the resolution with criminal case No. 103.
5. To send a copy of the resolution to the prosecutors of the Nagatinsky Inter-District Prosecutor's Office and the Lyublinsky Inter-District Prosecutor's Office of the city of Moscow.
