о соединении уголовных дел

рассмотрев материалы уголовного дела № 103 о совершении преступлений, предусмотренных ч.3 ст. 205 и ч. 3 ст. 222 УК РФ, и материалы уголовного дела № 173 о совершении преступлений, предусмотренных ч.2 ст. 105 и ч. 3 ст. 205 УК РФ,

УСТАНОВИЛ:

Настоящие уголовные дела возбуждены по фактам взрывов в сентябре 1999 года жилых домов в городах Москве и Волгодонске. В ходе расследования указанных преступлений получены достаточные доказательства того, что они совершены одной и той же группой лиц в составе Гочияева А.Ш., Деккушева А.О., Крымшамхалова Ю.И., Батчаева Т.А. и др., которые привлечены в качестве обвиняемых по уголовному делу № 103 — находящемуся в производстве Следственного управления ФСБ России и уголовному делу № 173 — находящемуся в производстве следственного отдела УФСБ России по Ростовской области.

На основании изложенного и руководствуясь ст. 153 УПК РФ,

ПОСТАНОВИЛ:

1. Уголовное дело № 103 соединить в одно производство с уголовным делом № 173, присвоив соединенному уголовному делу № 103.
2. Производство предварительного следствия по уголовному делу № 103 поручить Следственному управлению ФСБ России.

on the joinder of criminal cases

having reviewed the materials of criminal case No. 103 regarding the commission of crimes provided for by Part 3 of Art. 205 and Part 3 of Art. 222 of the Criminal Code of the RF, and the materials of criminal case No. 173 regarding the commission of crimes provided for by Part 2 of Art. 105 and Part 3 of Art. 205 of the Criminal Code of the RF,

HAS ESTABLISHED:

• The present criminal cases were initiated based on the facts of the bombings of residential buildings in the cities of Moscow and Volgodonsk in September 1999.
• During the investigation of the specified crimes, sufficient evidence was obtained that they were committed by one and the same group of persons consisting of A.Sh. Gochiyayev, A.O. Dekkushev, Yu.I. Krymshamkhalov, T.A. Batchayev, and others, who have been brought as defendants in criminal case No. 103 — currently under the jurisdiction of the Investigative Department of the FSB of Russia, and criminal case No. 173 — currently under the jurisdiction of the investigative department of the UFSB of Russia for the Rostov Region.

Based on the foregoing and guided by Art. 153 of the Code of Criminal Procedure of the RF,

HAS RESOLVED:

1. To join criminal case No. 103 into a single proceeding with criminal case No. 173, assigning the joined criminal case number 103.
2. To entrust the conduct of the preliminary investigation for criminal case No. 103 to the Investigative Department of the FSB of Russia.
