о выделении уголовного дела

рассмотрев материалы уголовного дела № 103

УСТАНОВИЛ:

Настоящее уголовное дело возбуждено по фактам взрывов 8, 13 и 16 сентября 1999 г. трех жилых домов в г.г. Москве и Волгодонске, то есть по признакам преступлений, предусмотренных ст.ст. 105, 205 и 222 Уголовного кодекса Российской Федерации, а расследование данных актов терроризма поручено Следственному управлению ФСБ России.
В ходе предварительного следствия были получены достаточные доказательства о том, что эти преступления совершены по указанию находившихся на территории Чеченской Республики главарей незаконных вооруженных формирований (НВФ) арабских наемников Хаттаба и Абу Умара, подчиненными им членами НВФ Гочияевым А.Ш., Крымшамхаловым Ю.И., Батчаевым Т.А., Декушевым А.О., Абаевым Х.М., Сайтаковым Д.Ф., Асхабовым Ш.Д., Батчаевым З.А. и Цокиевым М.Д., которые затем скрылись от следствия и суда на контролируемой боевиками территории.
14 июля 2002 г. был задержан и экстрадирован из Грузии в Россию один из активных участников названной преступной группы Деккушев А.О., которому в тот же день предъявлено обвинение и применена мера пресечения в виде содержания под стражей. Допрошенный по существу инкриминированных ему преступлений, Деккушев признал себя виновным в их совершении совместно с поименованными выше лицами и дал подробные показания об обстоятельствах исполнения полученного от Хаттаба и Абу Умара приказа по взрывам жилых домов в г.г. Москве и Волгодонске.
Одновременно, к настоящему времени, наряду с продолжением розыска и расследованием преступной деятельности Гочияева, Крымшамхалова, Батчаевых, Абаева, Сайтакова, Асхабова и Цокиева, с участием Деккушева выполнены практически все следственные действия по существу предъявленного ему обви..

RESOLUTION

on the severance of a criminal case

Investigator (inquirer): Senior Investigator for Especially Important Cases of the Investigative Department of the FSB of Russia, Captain of Justice Ignatyev V.A., having reviewed the materials of criminal case No. 103

ESTABLISHED:

• This criminal case was initiated regarding the facts of the explosions on September 8, 13, and 16, 1999, of three residential buildings in the cities of Moscow and Volgodonsk, i.e., based on the elements of crimes provided for by Articles 105, 205, and 222 of the Criminal Code of the Russian Federation, and the investigation of these acts of terrorism was assigned to the Investigative Department of the FSB of Russia.
• During the preliminary investigation, sufficient evidence was obtained that these crimes were committed on the instructions of the leaders of illegal armed formations (IAF) located on the territory of the Chechen Republic, Arab mercenaries Khattab and Abu Umar, by members of the IAF subordinate to them: Gochiyayev A.Sh., Krymshamkhalov Yu.I., Batchayev T.A., Dekushev A.O., Abayev Kh.M., Saitakov D.F., Askhabov Sh.D., Batchayev Z.A., and Tsokiyev M.D., who then fled from the investigation and the court to territory controlled by militants.
• On July 14, 2002, one of the active members of the named criminal group, Dekkushev A.O., was detained and extradited from Georgia to Russia; on the same day, he was charged and a preventive measure in the form of detention was applied. Questioned on the merits of the crimes incriminated to him, Dekkushev pleaded guilty to committing them together with the persons named above and gave detailed testimony about the circumstances of the execution of the order received from Khattab and Abu Umar regarding the explosions of residential buildings in the cities of Moscow and Volgodonsk.
• Simultaneously, to date, along with the continuation of the search and investigation of the criminal activities of Gochiyayev, Krymshamkhalov, the Batchayevs, Abayev, Saitakov, Askhabov, and Tsokiyev, with the participation of Dekkushev, almost all investigative actions on the merits of the charges brought against him have been completed.
