о продлении срока содержания под стражей

Федеральный судья Басманного районного суда ЦАО г. Москвы Мушникова Н.Е., с участием старшего прокурора отдела по надзору за расследованием особо важных дел управления по расследованию особо важных дел Генеральной прокуратуры Российской Федерации советника юстиции Ивановой Ю.И., обвиняемого Деккушева Адама Османовича, защитника Тарасевич Н.И., представившей удостоверение № 1924 МГКА и ордер № 1960 от 04 ноября 2002 года, при секретаре Белеховой С.С., рассмотрел постановление старшего следователя по особо важным делам Управления по расследованию особо важных дел Генеральной прокуратуры Российской Федерации старшего советника юстиции Зипунникова И.И. о возбуждении перед судом ходатайства о продлении срока содержания под стражей обвиняемого Деккушева Адама Османовича 03 февраля 1962 года рождения, уроженца города Карачаевска, гражданина Российской Федерации, зарегистрированного по адресу: город Карачаевск, улица Ленина, дом 75, обвиняемого в совершении преступлений, предусмотренных ст. ст. 205 ч. 3, 222 ч. 3 УК РФ,

Проверив представленные материалы, заслушав мнение прокурора Ивановой Ю.И., обвиняемого Деккушева А.О., защитника Тарасевич Н.И., судья

УСТАНОВИЛ:

Органами уголовного преследования Деккушев А.О. обвиняется в том, что совершил преступления, предусмотренные ст. ст. 205 ч.3, 222 ч. 3 УК РФ, а именно: В августе-сентябре 1999 года Деккушев А.О., действуя в составе организованной группы, спланировавшей совершение в городе Москве серии актов терроризма, совместно с Гочияевым А.Ш., Сайтаковым Д.Ф., Батчаевым Т.А., Крымшамхаловым Ю.И. и рядом других лиц, доставил автотранспортом с территории Северного Кавказа и разместил в нежилых помещениях города Москвы по адресам: улица Борисовские пруды, дом 16, корпус 2 и улице Краснодарская, дом 70 около 12 тонн изготовленных кустарным способом взрывчатых веществ со средствами взрывания, после чего в течение 7-8 сентября 1999 года Деккушев А.О. с помощью тех же соучастников вывез с указанных складов две партии взрывчатых веществ к выбранным местам запланированных актов терроризма в снятых для этой цели нежилых помещениях домов № 19 по улице Гурьянова и № 6 по Каширскому шоссе. 8 и 13 сентября 1999 года с использованием указанных устройств Деккушев А.О. совместно с Гочияевым, Сайтаковым, Батчаевым, Крымшамхаловым и другими соучастниками осуществил взрывы указанных домов вместе с проживавшими в них гражданами, в результате которых погибло 223 человека, более 150 жителей получили ранения различной степени тяжести, а дома были разрушены.

В постановлении о возбуждении перед судом ходатайства о продлении Деккушеву А.О. срока содержания под стражей старшим следователем Генеральной прокуратуры Зипунников И.И. указывает, что предварительное следствие по уголовному делу невозможно закончить в установленные сроки, поскольку по делу необходимо завершить производство судебно-биологической экспертизы по одежде Деккушева А.О., завершить ознакомление обвиняемого Деккушева А.О. с заключениями проведенных судебных экспертиз, завершить процесс признания около 100 лиц, пострадавших от террористического акта 16 сентября 1999 года в г. Волгодонске потерпевшими и гражданскими истцами, провести ряд других следственных действий по закреплению собранных по делу доказательств, после чего предъявить Деккушеву А.О. обвинение в

Mushnikova, with the participation of the Senior Prosecutor of the Department for Supervision of the Investigation of Especially Important Cases of the Directorate for the Investigation of Especially Important Cases of the General Prosecutor's Office of the Russian Federation, Counselor of Justice Yu.I. Ivanova, the accused Adam Osmanovich Dekkushev, defense attorney N.I. Tarasevich, who presented certificate No. 1924 of the MGKA [Moscow City Bar Association] and warrant No. 1960 dated November 04, 2002, with secretary S.S. Belekhova, considered the petition of the Senior Investigator for Especially Important Cases of the Directorate for the Investigation of Especially Important Cases of the General Prosecutor's Office of the Russian Federation, Senior Counselor of Justice I.I. Zipunnikov, to initiate before the court a motion to extend the period of detention of the accused Adam Osmanovich Dekkushev, born February 03, 1962, a native of the city of Karachayevsk, a citizen of the Russian Federation, registered at the address: city of Karachayevsk, Lenin Street, house 75, accused of committing crimes provided for by Articles 205 part 3, 222 part 3 of the Criminal Code of the Russian Federation.

Having verified the submitted materials, heard the opinion of Prosecutor Yu.I. Ivanova, the accused A.O. Dekkushev, and defense attorney N.I. Tarasevich, the judge

ESTABLISHED:

The criminal prosecution authorities accuse A.O. Dekkushev of committing crimes provided for by Articles 205 part 3, 222 part 3 of the Criminal Code of the Russian Federation, namely:

• In August-September 1999, A.O. Dekkushev, acting as part of an organized group that planned to commit a series of acts of terrorism in the city of Moscow, together with A.Sh. Gochiyayev, D.F. Saitakov, T.A. Batchayev, Yu.I. Krymshamkhalov, and a number of other persons, delivered by motor transport from the territory of the North Caucasus and placed in non-residential premises in the city of Moscow at the addresses: Borisovskiye Prudy Street, house 16, building 2, and Krasnodarskaya Street, house 70, about 12 tons of clandestinely manufactured explosive substances with means of detonation.
• After which, during September 7-8, 1999, A.O. Dekkushev, with the help of the same accomplices, removed two batches of explosive substances from the specified warehouses to the selected locations of the planned acts of terrorism in non-residential premises rented for this purpose in houses No. 19 on Guryanova Street and No. 6 on Kashirskoye Shosse.
• On September 8 and 13, 1999, using the specified devices, A.O. Dekkushev, together with Gochiyayev, Saitakov, Batchayev, Krymshamkhalov, and other accomplices, carried out the explosions of the specified houses along with the citizens living in them, as a result of which 223 people died, more than 150 residents received injuries of varying degrees of severity, and the houses were destroyed.

In the petition to initiate before the court a motion to extend the period of detention for A.O. Dekkushev, Senior Investigator of the General Prosecutor's Office I.I. Zipunnikov indicates that the preliminary investigation of the criminal case cannot be completed within the established timeframe, since it is necessary to:

• Complete the forensic biological examination of A.O. Dekkushev's clothing.
• Complete the familiarization of the accused A.O. Dekkushev with the conclusions of the conducted forensic examinations.
• Complete the process of recognizing about 100 persons affected by the terrorist act of September 16, 1999, in the city of Volgodonsk as victims and civil plaintiffs.
• Conduct a number of other investigative actions to consolidate the evidence collected in the case, after which to present A.O. Dekkushev with a charge of
