ПОСТАНОВЛЕНИЕ
о назначении взрывотехнической экспертизы

г. Волгодонск 25 сентября 1999 года

Старший следователь по особо важным делам следственного отдела Управления ФСБ России по Ростовской области майор юстиции Круглов А. В., рассмотрев материалы уголовного дела № 173,

УСТАНОВИЛ:

16 сентября 1999 года, в 5 часов 57 минут, в г. Волгодонске Ростовской области во дворе дома № 35 по Октябрьскому шоссе Батчаевым Т. А., Крымшамхаловым Ю.И. и другими совершен взрыв, в результате которого погибли 17 человек, свыше 300 человек получили телесные повреждения различной степени тяжести, а также причинен значительный материальный ущерб.
В ходе осмотра места происшествия обнаружены и изъяты деформированные фрагменты автомобилей со следами взрывного воздействия, получены образцы грунта и смывы, зафиксирована обстановка места происшествия.
Принимая во внимание, что для правильного решения по уголовному делу необходимо производство взрывотехнической экспертизы, руководствуясь статьями 78, 184 и 187 Уголовно-процессуального кодекса РСФСР,

ПОСТАНОВИЛ:

1. Назначить по настоящему делу взрывотехническую экспертизу производство которой экспертам в/ч 34435.
2. На разрешение экспертов поставить следующие вопросы:
   Образованы ли разрушения и повреждения объектов в результате действия взрыва?
   Какова масса и тротиловый эквивалент взорванного заряда?
   Какое именно взрывчатое вещество было использовано во взрывном устройстве?
   Какова область применения данного взрывчатого вещества?
   Где именно размещался заряд, какова конструкция и способ приведения в действие взрывного устройства?
3. В распоряжение экспертов представить протокол осмотра места происшествия от 16 сентября 1999 года с приложениями, отснятый на месте взрыва видеоматериал, образцы грунта, металлические фрагменты и смывы, протокол осмотра предметов от 20 сентября 1999 года с приложениями, копию протокола допроса подозреваемого Искандерова А.И., копию протокола допроса свидетеля Искандеровой В.В.

В связи с расследованием уголовного дела № 173 по факту взрыва в г. Волгодонске 16 сентября 1999 года направляем Вам материалы для производства взрывотехнической экспертизы Вашим сотрудникам, разъяснив им права и обязанности, предусмотренные статьей 82 Уголовно-процессуального кодекса РСФСР, а также предупредить их об ответственности за дачу заведомо ложного заключения по статье 307 Уголовного кодекса Российской Федерации, отобрав у них соответствующую расписку.
Образцы грунта, смывы, а также наиболее информативные фрагменты, обнаруженные в ходе осмотра места происшествия, направлялись в Ваш адрес ранее.
В случае необходимости акты обследования зданий и отчет о повреждениях домов в районе взрыва будут направлены дополнительно по поступлению указанных документов из администрации г. Волгодонска.

on the appointment of an explosive-technical expert examination

Senior Investigator for Especially Important Cases of the Investigative Department of the FSB Directorate of Russia for the Rostov Region, Major of Justice A. V. Kruglov, having reviewed the materials of criminal case No. 173,

HAS ESTABLISHED:

• On September 16, 1999, at 5:57 AM, in the city of Volgodonsk, Rostov Region, in the courtyard of house No. 35 on Oktyabrskoye Shosse, T. A. Batchayev, Yu. I. Krymshamkhalov, and others carried out an explosion, as a result of which 17 people died, over 300 people received bodily injuries of varying degrees of severity, and significant material damage was caused.
• During the inspection of the scene, deformed fragments of vehicles with traces of explosive impact were discovered and seized, soil samples and washings were obtained, and the scene of the incident was recorded.
• Taking into account that for a correct decision on the criminal case, an explosive-technical expert examination is necessary, guided by Articles 78, 184, and 187 of the Criminal Procedure Code of the RSFSR,

HAS RESOLVED:

1. To appoint an explosive-technical expert examination in this case, the production of which [is assigned] to the experts of military unit 34435.
2. To submit the following questions for the experts' resolution:
   • Were the destruction and damage to the objects formed as a result of an explosion?
   • What is the mass and TNT equivalent of the detonated charge?
   • What specific explosive substance was used in the explosive device?
   • What is the field of application of this explosive substance?
   • Where exactly was the charge located, what was the design and method of detonating the explosive device?
3. To provide the experts with the scene inspection report dated September 16, 1999, with appendices, video material filmed at the explosion site, soil samples, metal fragments and washings, the object inspection report dated September 20, 1999, with appendices, a copy of the interrogation report of suspect A. I. Iskanderov, and a copy of the interrogation report of witness V. V. Iskanderova.

In connection with the investigation of criminal case No. 173 regarding the explosion in Volgodonsk on September 16, 1999, we are sending you materials for the production of an explosive-technical expert examination by your employees, having explained to them the rights and duties provided for by Article 82 of the Criminal Procedure Code of the RSFSR, and also to warn them of the responsibility for providing a knowingly false conclusion under Article 307 of the Criminal Code of the Russian Federation, having obtained the appropriate receipt from them.
Soil samples, washings, as well as the most informative fragments discovered during the inspection of the scene, were sent to your address earlier.
If necessary, building inspection reports and a report on damage to houses in the explosion area will be sent additionally upon receipt of the specified documents from the administration of Volgodonsk.
