RESOLUTION

on the initiation of a criminal case

Senior Assistant to the Prosecutor General of the Russian Federation, State Counselor of Justice 3rd Class, V.P. Kravchenko, having reviewed the materials of the inquiry into the statement of Shakhnazarov,

HAS ESTABLISHED:

  • On February 13, 2002, Shakhnazarov A.A., a lawyer from Legal Consultation Office No. 1 of Cherkessk, approached the Directorate of the FSB of the RF for the KChR [Karachay-Cherkess Republic] with a statement.
  • He claimed that employees of the investigative group of the Prosecutor General's Office of the RF, V. Turlaev and A. Solzhenitsyn, during the period of May 2001 – January 2002, received bribes from him for the release from custody of persons arrested in the criminal case initiated regarding the fact of the explosions on the territory of Kavkazskie Mineralnye Vody and the Karachay-Cherkess Republic.
  • During the inquiry, Shakhnazarov's statement was not confirmed.
  • By a resolution dated December 25, 2001, the initiation of a criminal case against the investigators of the investigative group was refused for lack of corpus delicti.
  • Upon the receipt of the statement, Shakhnazarov was warned of criminal liability under Article 306 of the Criminal Code of the RF for a knowingly false report.

Guided by Article 211, point 11 of the CCP of the RSFSR,

HAS RESOLVED:

  1. To initiate a criminal case against Shakhnazarov A.A. for the elements of the crime provided for by Part 2 of Article 306 of the Criminal Code of the RF.
  2. To entrust the investigation of the case to the Deputy Head of the Directorate of the Prosecutor General's Office in the North Caucasus, M.M. Umariev.
