ОБВИНИТЕЛЬНОЕ ЗАКЛЮЧЕНИЕ
по уголовному делу № 970
По обвинению Мыльникова Анатолия Викторовича в совершении преступлений, предусмотренных ч. 1 ст. 205, ч. 3 ст. 30 и ч. 4 ст. 150 УК РФ

Настоящее уголовное дело возбуждено 18 июля 2000 г. Следственной службой УФСБ РФ по г. Москве и Московской области по признакам преступления, предусмотренного ст. 207 УК РФ.
Основанием для возбуждения уголовного дела послужили материалы проверки оперативного подразделения УФСБ РФ по г. Москве и МО по фактам поступления 21 августа в Генеральную прокуратуру РФ и 7 сентября 1999 года в редакцию средства массовой информации — «Новую газету» письменных обращений от имени т. н. «Добровольцев России», содержащих требование к органам власти освободить арестованную органами МВД Зандер Н.В. и угрозу, что «...в противном случае, через каждые 7 дней будут взлетать на воздух коммуникации, здания и т.д.». Проведенными оперативно-розыскными мероприятиями установлен автор текста и отправитель обращений — житель г. Москвы Мыльников Анатолий Викторович, 1946 г. р., уроженец г. Ивано-Франковска, русский, гражданин РФ, работавший начальником службы экономической безопасности ЗАО «Золотые страницы», ранее неоднократно судимый, в т.ч. и за совершение особо тяжких преступлений. Данная информация была подтверждена заявлением жительницы гор. Москвы Тумасян А.Э., обратившейся 19 мая 2000 года в УФСБ РФ МО, в котором она указала на Мыльникова А.В. как на автора текста «Обращения» и его отправителя в различные организации. Обстоятельства данного преступления она подтвердила в ходе предварительного следствия.

В ходе установления обстоятельств совершенного деяния был допрошен Мыльников А.В., который свою причастность к изготовлению «Обращения» и его рассылке отрицал. После допроса в Следственной службе скрылся, на вызовы не являлся.
12 сентября и 15 ноября 2000 года срок предварительного следствия продлевался прокурором г. Москвы соответственно до 4 и до 5 месяцев.
С учетом полученных в ходе предварительного следствия доказательств 8 ноября 2000 года вынесено постановление о привлечении (заочно) в качестве обвиняемого Мыльникова А.В. в совершении преступления, предусмотренного ст. 207 УК РФ.
14 ноября 2000 года вынесено постановление о приводе обвиняемого Мыльникова А.В.
18 декабря 2000 года вынесено постановление о приостановлении предварительного следствия и розыске обвиняемого Мыльникова А.В. на основании п. 1 ст. 195 УПК РСФСР.
19 декабря 2001 года вынесено постановление о возобновлении приостановленного предварительного следствия и о возбуждении ходатайства об установлении срока следствия по делу до 19 января 2002 года.
15 января 2002 г. Мыльников А.В. доставлен в Следственную службу, где ему было предъявлено обвинение в совершении преступления, предусмотренного ст. 207 УК РФ, и избрана мера пресечения в виде заключения под стражу.
18 января, 7 марта и 8 мая 2002 года срок предварительного следствия продлевался Заместителем Генерального прокурора РФ соответственно до семи месяцев и двадцати четырех дней, до девяти месяцев и двадцати трех дней и до десяти месяцев и двадцати трех дней.
1 марта и 26 апреля 2002 года срок содержания под стражей обвиняемого Мыльникова продлевался прокурором г. Москвы соответственно до 4 и 5 месяцев.
Законность и обоснованность продления срока содержания под стражей обвиняемый Мыльников 13 марта 2002 года обжаловал в судебном порядке, однако решением Лефортовского межмуниципального суда г. Москвы его жалоба оставлена без удовлетворения.

10 июня 2002 года в соответствии с указанием прокурора г. Москвы (в порядке ст. 211 УПК РСФСР) мера пресечения в виде заключения под стражу, примененная в отношении Мыльникова А.В. изменена на залог.

Предварительным следствием установлено, что летом 1999 г., на квартире Зандер Н.В. по адресу: г. Москва, Свободный проспект, д.28, кв. 82, находившейся в тот период под стражей в связи с привлечением к уголовной ответственности, Мыльников А.В. в присутствии своей подчиненной — нештатной сотрудницы службы безопасности издательского дома «Золотые страницы», несовершеннолетней Тумасян А.Э. лично подготовил рукописный текст «Обращения» от имени т.н. «Добровольцев России», в котором органам власти было предъявлено требование освободить из-под стражи арестованную органами МВД Зандер Н.В., а также высказана угроза — «будут взлетать на воздух коммуникации, здания и т.д.» через каждые 7 дней, в случае неисполнения до 1 сентября 1999 года указанного выше требования. Текст указанного «Обращения» он передал Тумасян А.Э. и склонил её подготовить письма в адрес...

INDICTMENT

in criminal case No. 970

On the charges against Anatoly Viktorovich Mylnikov for committing crimes under Part 1 of Art. 205, Part 3 of Art. 30 and Part 4 of Art. 150 of the Criminal Code of the Russian Federation.

This criminal case was initiated on July 18, 2000, by the Investigative Service of the Directorate of the Federal Security Service (UFSB) of the Russian Federation for the city of Moscow and the Moscow Region on the grounds of a crime under Art. 207 of the Criminal Code of the Russian Federation.

The grounds for initiating the criminal case were the materials of an investigation by the operational unit of the UFSB of the Russian Federation for the city of Moscow and the Moscow Region regarding the receipt on August 21 by the Prosecutor General's Office of the Russian Federation and on September 7, 1999, by the editorial office of the mass media outlet "Novaya Gazeta" of written appeals on behalf of the so-called "Volunteers of Russia," containing a demand to the authorities to release N.V. Zander, who had been arrested by the Ministry of Internal Affairs (MVD), and a threat that "...otherwise, every 7 days, communications, buildings, etc. will be blown up." Operational-search measures established the author of the text and the sender of the appeals — a resident of Moscow, Anatoly Viktorovich Mylnikov, born in 1946, a native of Ivano-Frankivsk, Russian, a citizen of the Russian Federation, who worked as the head of the economic security service of CJSC "Zolotye Stranitsy" (Golden Pages), previously convicted multiple times, including for committing particularly serious crimes. This information was confirmed by a statement from a resident of Moscow, A.E. Tumasyan, who applied to the UFSB of the Russian Federation for the Moscow Region on May 19, 2000, in which she identified A.V. Mylnikov as the author of the text of the "Appeal" and its sender to various organizations. She confirmed the circumstances of this crime during the preliminary investigation.

During the establishment of the circumstances of the committed act, A.V. Mylnikov was interrogated, who denied his involvement in the preparation of the "Appeal" and its distribution. After the interrogation at the Investigative Service, he went into hiding and did not respond to summons.

• On September 12 and November 15, 2000, the period of the preliminary investigation was extended by the Prosecutor of Moscow to 4 and 5 months, respectively.
• On November 8, 2000, a resolution was issued to charge (in absentia) A.V. Mylnikov with committing a crime under Art. 207 of the Criminal Code of the Russian Federation.
• On November 14, 2000, a resolution was issued for the forced appearance of the accused A.V. Mylnikov.
• On December 18, 2000, a resolution was issued to suspend the preliminary investigation and search for the accused A.V. Mylnikov on the basis of paragraph 1 of Art. 195 of the Code of Criminal Procedure of the RSFSR.
• On December 19, 2001, a resolution was issued to resume the suspended preliminary investigation and to initiate a petition to establish the period of investigation in the case until January 19, 2002.
• On January 15, 2002, A.V. Mylnikov was brought to the Investigative Service, where he was charged with committing a crime under Art. 207 of the Criminal Code of the Russian Federation, and a preventive measure in the form of detention was chosen.
• On January 18, March 7, and May 8, 2002, the period of the preliminary investigation was extended by the Deputy Prosecutor General of the Russian Federation to seven months and twenty-four days, nine months and twenty-three days, and ten months and twenty-three days, respectively.
• On March 1 and April 26, 2002, the period of detention of the accused Mylnikov was extended by the Prosecutor of Moscow to 4 and 5 months, respectively.
• On March 13, 2002, the accused Mylnikov appealed the legality and validity of the extension of the period of detention in court; however, by the decision of the Lefortovo Inter-Municipal Court of Moscow, his appeal was dismissed.

• On June 10, 2002, in accordance with the instructions of the Prosecutor of Moscow (pursuant to Art. 211 of the Code of Criminal Procedure of the RSFSR), the preventive measure in the form of detention applied to A.V. Mylnikov was changed to bail.

The preliminary investigation established that in the summer of 1999, at the apartment of N.V. Zander at the address: Moscow, Svobodny Prospekt, 28, apt. 82, who was in custody at that time in connection with criminal prosecution, A.V. Mylnikov, in the presence of his subordinate — a part-time security service employee of the "Zolotye Stranitsy" publishing house, the minor A.E. Tumasyan, personally prepared the handwritten text of the "Appeal" on behalf of the so-called "Volunteers of Russia," in which a demand was made to the authorities to release N.V. Zander, who had been arrested by the MVD, and a threat was made — "communications, buildings, etc. will be blown up" every 7 days, in case of failure to comply with the above demand by September 1, 1999.
