Incident Summary

The group possessed:
* Plasticite
* About 40 electric detonators
* 6 radio-controlled explosive devices with 2 remote controls for them
* 2 hand grenades
* A Kalashnikov assault rifle with an under-barrel grenade launcher
* A PM pistol and ammunition for the named firearms

The group, which had previously divided into two, left the combat zone on the territory of the Chechen Republic.

• The first group included:
  • Gochiyayev A.Sh.
  • Bostanov M.I.
  • Bostanov A.R.
  • Frantsuzov T.K.
• The second group included:
  • Krymshamkhalov Yu.I.
  • Tuganbaev M.M.
  • Totorkulov B.D.

Krymshamkhalov Yu.I. was unable to complete the planned crime due to circumstances beyond his control. Along the route near the village of Komsomolskoye, his group was surrounded by units of the Armed Forces and law enforcement agencies of the Russian Federation conducting an operation to destroy an IAF (Illegal Armed Formation) led by Ruslan Gelayev.

During resistance against law enforcement agencies:
* Totorkulov B.D. was killed.
* Krymshamkhalov Yu.I. was forced to join Ruslan Gelayev's IAF and break out of the encirclement with him.

Other members of the organized criminal group also failed to realize their criminal intent due to circumstances beyond their control.

Charges Against Krymshamkhalov Yu.I.

By his actions, Krymshamkhalov Yu.I., as part of an organized group, committed:

• Preparation for acts of terrorism in the city of Moscow: This involved the commission of explosions, arsons, and other actions creating a danger of loss of life, causing significant property damage, or the occurrence of other socially dangerous consequences, for the purpose of violating public safety, intimidating the population, and exerting influence on decision-making by government bodies. This is a crime provided for by Part 1 of Art. 30 and Part 3 of Art. 205 of the Criminal Code of the Russian Federation.

By his actions related to the acquisition, during the preparation and commission of terrorist acts, and during his participation in the IAF, of explosives and means of their detonation, assault rifles, and a pistol with cartridges for them, combat grenades, their storage, carrying, and transportation, Krymshamkhalov Yu.I., as part of an organized group, repeatedly committed:

• Illegal acquisition, storage, transportation, and carrying of firearms, ammunition, explosives, and explosive devices. This is a crime provided for by Part 3 of Art. 222 of the Criminal Code of the Russian Federation.
