ем, ношением и перевозкой, Деккушев А.О. в составе организованной группы неоднократно совершил незаконные приобретение, хранение, перевозку и ношение огнестрельного оружия, боеприпасов, взрывчатых веществ и взрывных устройств, то есть преступление, предусмотренное ч.3 ст.222 УК РФ.

Одновременно, своими действиями, выразившимися в изготовлении при изложенных выше обстоятельствах в ходе подготовки терактов свыше 14 тонн взрывчатого вещества и взрывных устройств для его подрыва, Деккушев А.О. в составе организованной группы неоднократно совершил незаконное изготовление взрывчатых веществ и взрывных устройств, то есть преступление, предусмотренное ч.3 ст.223 УК РФ.

Вместе с тем, в сентябре 1999 г. Деккушев А.О., реализовывая при изложенных выше обстоятельствах планы организованной группы по проведению крупномасштабных актов терроризма в Российской Федерации в целях устрашения населения и оказания воздействия на принятие решений органами власти и действуя совместно с Гочияевым А.Ш., Крымшамхаловым Ю.И., Батчаевым Т.А., Батчаевым З.А., Сайтаковым Д.Ф., Абаевым Х.М., Цокиевым М.Д. и неустановленными лицами, лично и при непосредственном исполнении названных выше участников организованной группы с использованием изготовленного и доставленного ими в города Москву и Волгодонск взрывчатого вещества и средств его подрыва совершил посягательства на жизнь людей, находившихся во взорванных ими жилых домах и на прилегающей к ним территории.

8 сентября 1999 г. примерно в 24 часа, реализовывая умысел вышеназванной организованной преступной группы, направленный на убийство максимального количества людей, находившихся в тот момент в близлежащих многоэтажных жилых домах № 19 и № 17 по ул. Гурьянова в г. Москве и на прилегающей к ним территории, Гочияев А.Ш., Батчаев З.А., Сайтаков Д.Ф., Абаев Х.М. и неустановленные лица в составе организованной группы с использованием электрического взрывателя замедленного действия с электронным таймером произвели подрыв упомянутого выше са-модельного взрывного устройства большой мощности, располагавшегося в нежилом помещении на 1 этаже дома № 19 на ул. Гурьянова.

В результате взрыва от воздействия разрушенных конструкций здания, осколков разбитого стекла, возникшего пожара и задымления, ударной и звуковой волн взрыва, вторичных снарядов - предметов обстановки квартир, в которых находились пострада...

Specific Incident in Moscow

• On September 8, 1999, at approximately 24:00, implementing the intent of the aforementioned organized criminal group aimed at killing the maximum number of people who were at that moment in the nearby multi-story residential buildings No. 19 and No. 17 on Guryanova Street in Moscow and on the adjacent territory, Achimez Gochiyayev, Z.A. Batchaev, Denis Saitakov, Kh.M. Abaev, and unidentified persons as part of an organized group, using a delayed-action electric detonator with an electronic timer, detonated the aforementioned high-power improvised explosive device located in a non-residential premise on the 1st floor of building No. 19 on Guryanova Street.
