Уважаемый Сергей Дмитриевич!

В производстве Следственного управления ФСБ России находится уголовное дело № 103, в котором соединены три уголовных дела, возбужденных: 09.09.1999 по ст. ст. 205 и 105 УК РФ по факту взрыва жилого дома по ул. Гурьянова в г. Москве; 13.09.1999 по ст. ст. 205 и 105 УК РФ по факту взрыва жилого дома по Каширскому шоссе в г. Москве; 16.09.1999 по ст. ст. 205 и 105 УК РФ по факту взрыва у подъезда жилого дома по ул. Октябрьское шоссе в г. Волгодонске.
В ходе предварительного следствия установлено, что акты терроризма совершены в составе группы: Гочияев А.Ш., Крымшамхалов Ю.И., Батчаев Т.А., Деккушев Х.М., которым заочно предъявлено обвинение по ч. 3 ст. 205 и п. «а, е, ж, з» ч. 2 ст. 105 УК РФ. В настоящее время задержан Крымшамхалов, которому предъявлено обвинение по указанным статьям УК РФ. Помимо предъявленных составов преступлений, в действиях Крымшамхалова усматриваются признаки преступления, предусмотренного ст. 102 УК РФ.
Принимая во внимание, что, согласно ст. 151 УПК РФ, предварительное следствие по уголовным делам о преступлениях, предусмотренных ст. 105 УК РФ, производится исключительно следователями прокуратуры, в соответствии с требованиями п. 9 ст. 37 УПК РФ предлагаю из уголовного дела № 103 незамедлительно выделить в отдельное производство уголовное дело в отношении Крымшамхалова Ю.И. и передать его для дальнейшего расследования в управление по расследованию особо важных дел Генеральной прокуратуры РФ (индекс 18).

Dear Sergey Dmitrievich!

The Investigative Department of the FSB of Russia is handling criminal case No. 103, which combines three criminal cases initiated:
* On 09.09.1999 under Articles 205 and 105 of the Criminal Code of the Russian Federation regarding the explosion of a residential building on Guryanova St. in Moscow.
* On 13.09.1999 under Articles 205 and 105 of the Criminal Code of the Russian Federation regarding the explosion of a residential building on Kashirskoye Highway in Moscow.
* On 16.09.1999 under Articles 205 and 105 of the Criminal Code of the Russian Federation regarding the explosion at the entrance of a residential building on Oktyabrskoye Highway in Volgodonsk.

During the preliminary investigation, it was established that the acts of terrorism were committed as part of a group: A.Sh. Gochiyayev, Yu.I. Krymshamkhalov, T.A. Batchaev, Kh.M. Dekkushev, who were charged in absentia under Part 3 of Art. 205 and paragraphs "a, e, zh, z" of Part 2 of Art. 105 of the Criminal Code of the Russian Federation. Currently, Krymshamkhalov has been detained and charged under the specified articles of the Criminal Code of the Russian Federation. In addition to the charged offenses, Krymshamkhalov's actions show signs of a crime provided for by Art. 102 of the Criminal Code of the Russian Federation.

Taking into account that, according to Art. 151 of the Criminal Procedure Code of the Russian Federation, the preliminary investigation of criminal cases involving crimes provided for by Art. 105 of the Criminal Code of the Russian Federation is carried out exclusively by prosecutors' investigators, in accordance with the requirements of paragraph 9 of Art. 37 of the Criminal Procedure Code of the Russian Federation, I propose to immediately separate the criminal case against Yu.I. Krymshamkhalov from criminal case No. 103 into separate proceedings and transfer it for further investigation to the Department for the Investigation of Particularly Important Cases of the General Prosecutor's Office of the Russian Federation (index 18).
