THE PRICE OF FREEDOM IS NEGOTIABLE
In issue No. 26, an interview with lawyer L. Shakhnazarov was published under this headline. In that publication, the editors did not name the investigators whom the lawyer accused of releasing people guilty of terrorism in exchange for bribes. Moreover, Shakhnazarov claimed that the charges themselves were fabricated with the intent of obtaining a bribe.
We sent the publication to the prosecutor's office with a request to verify and comment on the facts presented. The response we received indicates that instead, the prosecutor's office opened a case against Shakhnazarov himself.
In a situation where supervisory bodies evade their direct functions, we consider it necessary to make public the names mentioned by Shakhnazarov.
Lawyer Shakhnazarov accused investigators Tkachev, Turlaev, and Solzhenitsyn of fabricating criminal cases to extort bribes and of receiving those bribes.
Below we publish the response from Mr. Markov, an official of the prosecutor's office, which could well qualify for a contest in legal hair-splitting.
To the Editor-in-Chief of "Novaya Gazeta"
The Department of the Prosecutor General's Office of the Russian Federation in the North Caucasus has considered your request for an additional check in connection with the publication in No. 26 (859) of "Novaya Gazeta" of the interview with A.A. Shakhnazarov.
I inform you that the check on the statement of A.A. Shakhnazarov regarding alleged abuses in the investigative group for the investigation of acts of terrorism in the Stavropol Krai was conducted not by the head of the group, I.I. Tkachev, as you indicated in the request, but by the Deputy Head of the Department of the Prosecutor General's Office of the Russian Federation in the North Caucasus, M.M. Umariev. Based on the results of the check, a decision was made to initiate a criminal case against A.A. Shakhnazarov under Article 306, Part 2 of the Criminal Code of the Russian Federation (knowingly false report).
The circumstances of the crime committed by A.A. Shakhnazarov were comprehensively and fully investigated during the investigation and trial of the criminal case. By the verdict of the Cherkessk City Court, A.A. Shakhnazarov was found guilty of committing a crime under Article 306, Part 2 of the Criminal Code of the Russian Federation and sentenced to 2 years of suspended imprisonment. The court's decision was not appealed by Shakhnazarov.
Regarding the facts of fraudulent actions by A.A. Shakhnazarov against the relatives of the accused — R.Kh. Koichueva and F.Kh. Gochiyayeva (sister of the accused Achimez Gochiyayev [referred to as R.Kh. Gochiyayev in text]) — a criminal case has been initiated on the grounds of a crime under paragraph "g" of Part 2 of Article 159 of the Criminal Code of the Russian Federation (fraud causing significant damage). The preliminary investigation of the criminal case has been completed, and the case is currently at the stage of trial in the Cherkessk City Court.
Taking the above into account, there are no grounds for an additional check.
During the investigation of the criminal case, it was established that A.A. Shakhnazarov had previously committed similar crimes, for which he was convicted in 1999 by the Kislovodsk City Court under Article 147, Part 3 of the Criminal Code of the RSFSR (fraud under aggravating circumstances) to 4 years of suspended imprisonment.
