Уважаемый Сергей Дмитриевич!

В производстве Следственного управления ФСБ России находится уголовное дело № 103. В данном деле соединены три уголовных дела, возбужденных: 09.09.1999 по ст. ст. 205 и 105 УК РФ по факту взрыва жилого дома по ул. Гурьянова в г. Москве; 13.09.1999 по ст. ст. 205 и 105 УК РФ по факту взрыва жилого дома по Каширскому шоссе в г. Москве; 16.09.1999 по ст. ст. 205 и 105 УК РФ по факту взрыва у подъезда жилого дома по ул. Октябрьское шоссе в г. Волгодонске.

В ходе предварительного следствия установлено, что акты терроризма совершены группой в составе: Гочияев А.Ш., Крымшамхалов Ю.И., Батчаев Т.А., Деккушев А.О., Сайтаков Д.Ф., Абаев Х.М., которым заочно предъявлено обвинение по ч. 3 ст. 205 и ч. 3 ст. 222 УК РФ. В настоящее время задержан Крымшамхалов, которому предъявлено обвинение по указанным статьям УК РФ. Помимо предъявленных составов преступлений в действиях Крымшамхалова усматриваются признаки преступления, предусмотренного ст. 105 УК РФ.

Учитывая, что, согласно ст. 151 УПК РФ, предварительное следствие по уголовным делам о преступлениях, предусмотренных ст. 105 УК РФ, производится исключительно следователями прокуратуры, в соответствии с требованиями п. 9 ст. 37 УПК РФ, прошу из уголовного дела № 103 незамедлительно выделить в отдельное производство уголовное дело в отношении Крымшамхалова Ю.И. и передать его для дальнейшего расследования в управление по расследованию особо важных дел Генеральной прокуратуры РФ (индекс 18).

Criminal case No. 103 is currently being handled by the Investigative Department of the FSB of Russia. This case combines three criminal cases initiated on:
* 09.09.1999 under Articles 205 and 105 of the Criminal Code of the Russian Federation regarding the explosion of a residential building on Guryanova St. in Moscow;
* 13.09.1999 under Articles 205 and 105 of the Criminal Code of the Russian Federation regarding the explosion of a residential building on Kashirskoye Highway in Moscow;
* 16.09.1999 under Articles 205 and 105 of the Criminal Code of the Russian Federation regarding the explosion at the entrance of a residential building on Oktyabrskoye Highway in Volgodonsk.

During the preliminary investigation, it was established that the acts of terrorism were committed by a group consisting of: Gochiyayev A.Sh., Krymshamkhalov Yu.I., Batchayev T.A., Dekkushev A.O., Saitakov D.F., Abayev Kh.M., who were charged in absentia under Part 3 of Art. 205 and Part 3 of Art. 222 of the Criminal Code of the Russian Federation. Currently, Krymshamkhalov has been detained and charged under the specified articles of the Criminal Code of the Russian Federation. In addition to the charges already filed, Krymshamkhalov's actions show signs of a crime provided for by Art. 105 of the Criminal Code of the Russian Federation.

Considering that, according to Art. 151 of the Criminal Procedure Code of the Russian Federation, preliminary investigation of criminal cases involving crimes provided for by Art. 105 of the Criminal Code of the Russian Federation is conducted exclusively by investigators of the prosecutor's office, in accordance with the requirements of paragraph 9 of Art. 37 of the Criminal Procedure Code of the Russian Federation, I request that the criminal case against Yu.I. Krymshamkhalov be immediately separated from criminal case No. 103 into a separate proceeding and transferred for further investigation to the Department for the Investigation of Especially Important Cases of the General Prosecutor's Office of the Russian Federation (index 18).
