У С Т А Н О В И Л :

Настоящее уголовное дело в отношении обвиняемого Деккушева А.О. выделено в отдель-
(излагаются сущность обвинения с указанием даты избрания меры пресечения в виде заключения под стражу, сроков нахожде-
ния обвиняемого под стражей (также указываются сроки задержания подозреваемого, домашнего ареста, принудительного на-
хождения в медицинском либо психиатрическом стационаре), сроков предыдущего продления содержания под стражей, исте-
чения сроков содержания под стражей, обоснование невозможности закончить предварительное следствие либо ознакомление
обвиняемого и его защитника с материалами уголовного дела в установленный срок и отсутствия оснований для изменения или
отмены меры пресечения)
ное производство 9 сентября 2002 г. из уголовного дела № 103, возбуждённого по фактам взры-
вов в жилых домах в городах Москве и Волгодонске Ростовской области в сентябре 1999 г.
9 сентября 1999 г. по факту взрыва в жилом доме № 19 по ул. Гурьянова в г. Москве было
возбуждено уголовное дело № 275209. 13 сентября 1999 г. были возбуждены уголовные дела
№275210 по факту взрыва в жилом доме № 6 корпус 3 по Каширскому шоссе в г. Москве и
№75908 в связи с обнаружением по адресу: г. Москва, ул. Борисовские пруды, дом 16, корпус 2,
взрывчатого вещества "амонал" весом около 1000 кг, а также электродетонаторов, промежуточ-
ных детонаторов и взрывателей с часовым механизмом. 22 сентября 1999 г. названные выше
уголовные дела были соединены в одно производство под № 103.
16 сентября 1999 г. было возбуждено уголовное дело № 173 по факту взрыва во дворе жи-
лого дома № 35 по Октябрьскому шоссе в г. Волгодонске Ростовской области. 8 августа 2002 г.
данное уголовное дело было соединено в одно производство с указанным выше уголовным де-
лом № 103, возбуждённым по фактам взрывов в жилых домах в г. Москве.
В ходе расследования уголовного дела установлено, что террористические акты - взрывы
в жилых домах в городах Москве и Волгодонске в сентябре 1999 г. совершены организованной
преступной группой, членами которой являлись руководители и участники незаконных воору-
жённых формирований на территории Чеченской Республики Эмир Ибн Аль-Хаттаб, Абу Аль
Валид Аль Гамиди, Гочияев А.Ш., Сайтаков Д.Ф., Крымшамхалов Ю.И., Батчаев Т.А., Абаев
Х.М., Деккушев А.О. и ряд других неустановленных следствием лиц.

H A S E S T A B L I S H E D :

The present criminal case against the accused A.O. Dekkushev was separated into a separate

proceeding on September 9, 2002, from criminal case No. 103, initiated regarding the facts of explosions in residential buildings in the cities of Moscow and Volgodonsk, Rostov Region, in September 1999.

Chronology of Related Cases:

• On September 9, 1999, criminal case No. 275209 was initiated regarding the fact of an explosion in residential building No. 19 on Guryanova St. in Moscow.
• On September 13, 1999, criminal cases No. 275210 were initiated regarding the fact of an explosion in residential building No. 6, building 3 on Kashirskoye Highway in Moscow, and No. 75908 in connection with the discovery at the address: Moscow, Borisovskie Prudy St., house 16, building 2, of the explosive substance "ammonal" weighing about 1000 kg, as well as electric detonators, intermediate detonators, and fuzes with a clock mechanism.
• On September 22, 1999, the above-mentioned criminal cases were joined into one proceeding under No. 103.
• On September 16, 1999, criminal case No. 173 was initiated regarding the fact of an explosion in the courtyard of residential building No. 35 on Oktyabrskoye Highway in Volgodonsk, Rostov Region.
• On August 8, 2002, this criminal case was joined into one proceeding with the above-mentioned criminal case No. 103, initiated regarding the facts of explosions in residential buildings in Moscow.

Findings of the Investigation:

During the investigation of the criminal case, it was established that the terrorist acts—explosions in residential buildings in the cities of Moscow and Volgodonsk in September 1999—were committed by an organized criminal group.

Members of this group included:
* Emir Ibn Al-Khattab
* Abu Al-Walid Al-Hamidi
* Gochiyayev A.Sh.
* Saitakov D.F.
* Krymshamkhalov Yu.I.
* Batchaev T.A.
* Abaev Kh.M.
* Dekkushev A.O.
* A number of other persons not identified by the investigation.

These individuals were leaders and participants of illegal armed formations on the territory of the Chechen Republic.
