The present criminal case against the accused A.O. Dekkushev was separated into a separate

proceeding on September 9, 2002, from criminal case No. 103, initiated regarding the facts of explosions in residential buildings in the cities of Moscow and Volgodonsk, Rostov Region, in September 1999.
Chronology of Related Cases:
- On September 9, 1999, criminal case No. 275209 was initiated regarding the fact of an explosion in residential building No. 19 on Guryanova St. in Moscow.
- On September 13, 1999, criminal cases No. 275210 were initiated regarding the fact of an explosion in residential building No. 6, building 3 on Kashirskoye Highway in Moscow, and No. 75908 in connection with the discovery at the address: Moscow, Borisovskie Prudy St., house 16, building 2, of the explosive substance "ammonal" weighing about 1000 kg, as well as electric detonators, intermediate detonators, and fuzes with a clock mechanism.
- On September 22, 1999, the above-mentioned criminal cases were joined into one proceeding under No. 103.
- On September 16, 1999, criminal case No. 173 was initiated regarding the fact of an explosion in the courtyard of residential building No. 35 on Oktyabrskoye Highway in Volgodonsk, Rostov Region.
- On August 8, 2002, this criminal case was joined into one proceeding with the above-mentioned criminal case No. 103, initiated regarding the facts of explosions in residential buildings in Moscow.
Findings of the Investigation:
During the investigation of the criminal case, it was established that the terrorist acts—explosions in residential buildings in the cities of Moscow and Volgodonsk in September 1999—were committed by an organized criminal group.
Members of this group included:
* Emir Ibn Al-Khattab
* Abu Al-Walid Al-Hamidi
* Gochiyayev A.Sh.
* Saitakov D.F.
* Krymshamkhalov Yu.I.
* Batchaev T.A.
* Abaev Kh.M.
* Dekkushev A.O.
* A number of other persons not identified by the investigation.
These individuals were leaders and participants of illegal armed formations on the territory of the Chechen Republic.

On 19 November 1999, rulings were issued in the case to charge A.O. Dekkushev as an accused under Part 3 of Art. 205 and Part 3 of Art. 222 of the Criminal Code of the Russian Federation, to select a preventive measure in the form of detention, and to place him on the wanted list.
On 14 July 2002, A.O. Dekkushev was detained by law enforcement agencies of the Republic of Georgia on the territory of said state and, in accordance with the 1993 Minsk Convention of the CIS countries, was transferred to the Russian Federation. On the same day, A.O. Dekkushev was charged, and detention was selected as the preventive measure against him.
A.O. Dekkushev is accused of:
* Illegally acquiring, storing, and transporting explosives and explosive devices by motor vehicle from the territory of the North Caucasus to Moscow in August-September 1999 as part of an organized criminal group.
* Carrying out terrorist acts using these explosives on 8 and 13 September 1999:
* Explosions in residential buildings No. 19 on Guryanova St. and No. 6 bldg 3 on Kashirskoye Highway, resulting in 223 people dying and more than 150 people receiving injuries of varying degrees of severity, causing significant material damage to the state and citizens.
Furthermore, sufficient evidence has been collected in the criminal case regarding the direct participation of A.O. Dekkushev in the execution, as part of the aforementioned organized criminal group, of the terrorist act on 16 September 1999 in Volgodonsk:
* An explosion in the courtyard of building No. 35 on Oktyabrskoye Highway, resulting in 19 people dying and over 1000 people receiving bodily injuries of varying degrees of severity, causing significant material damage to the state and citizens.
Necessary Investigative Actions
To investigate the case in full, the following actions are necessary:
1. Complete the forensic biological examination of the clothing of the accused A.O. Dekkushev, seized in September 1999 at his place of residence in Kislovodsk.
2. Complete the familiarization of the accused A.O. Dekkushev with the conclusions of the forensic examinations conducted in the criminal case (about 50 examinations).
3. Complete the process of recognizing about 100 persons affected by the terrorist act of 16 September 1999 in Volgodonsk as victims or civil plaintiffs in this criminal case.
4. Conduct a number of other investigative actions to consolidate the evidence collected in the case, after which A.O. Dekkushev must be charged in full.
Upon completion of the planned investigative actions, it will be necessary to familiarize the victims and civil plaintiffs (over 1500 people), as well as the accused A.O. Dekkushev and his defense counsel, with the materials of the criminal case in accordance with Articles 216 and 217 of the Code of Criminal Procedure of the Russian Federation, after which an indictment will be drawn up.
Timeline:
* At least 3 months will be required to perform all necessary investigative actions in the criminal case.
Detention Status:
* The period of detention for the accused A.O. Dekkushev expires on 9 November 2002.
* There are no grounds for changing this preventive measure against him, as he may:
* Flee from the preliminary investigation and the court.
* Continue to engage in criminal activity.
* Threaten witnesses and victims and otherwise obstruct the proceedings in the criminal case.
Decision
Based on the foregoing, guided by Art. 109 of the Code of Criminal Procedure of the Russian Federation,
DECIDED:
To petition the court, the Basmanny District Court of Moscow, to extend the period of detention of the accused Adam Osmanovich Dekkushev in criminal case No. 18/230300-02 for 3 months, for a total of 6 months 26 days, i.e., until 9 February 2003 inclusive.
