ESTABLISHED:

• On September 8, 13, and 16, 1999, regarding the facts of the explosions of three residential buildings in the cities of Moscow and Volgodonsk, criminal cases were initiated based on the elements of crimes provided for by Articles 105, 205, and 222 of the Criminal Code of the Russian Federation, which on August 8, 2002, were joined into a single proceeding by the Deputy Prosecutor General of the Russian Federation, State Counselor of Justice 1st Class Kolmogorov V.V., and its investigation was assigned to the Investigative Department of the FSB of Russia.
• During the preliminary investigation, sufficient evidence was obtained that these crimes were committed on the instructions of the leaders of illegal armed groups (IAG) of Arab mercenaries Khattab and Abu Umar, who were on the territory of the Chechen Republic, by members of the IAG subordinate to them: Gochiyayev A.Sh., Krymshamkhalov Yu.I., Batchayev T.A., Dekkushev A.O., Abayev Kh.M., Saitakov D.F., Batchayev Z.A., and Tsokiyev M.D., who fled from the investigation and the court to territory controlled by militants after committing the specified crimes.
• As a result of search operations conducted on December 7, 2002, Krymshamkhalov Yu.I. was detained and extradited from Georgia to Russia; on the same day, in the criminal case under investigation, he was charged under Part 3 of Article 205 and Part 3 of Article 222 of the Criminal Code of the Russian Federation, and a preventive measure in the form of detention was applied. Questioned on the merits of the crimes incriminated against him, Krymshamkhalov pleaded guilty to committing the explosion of a residential building in the city of Volgodonsk and gave detailed testimony about the circumstances of the preparation of the acts of terrorism under investigation.
